B-125906, NOV. 1, 1955

TO HONORABLE J. GEORGE STEWART, ARCHITECT OF THE CAPITOL:

REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 24, 1955, WITH ENCLOSURES, REQUESTING A DECISION AS TO WHETHER A BID DATED OCTOBER 12, 1955, SUBMITTED BY FRANK M. EWING COMPANY, INC., IN RESPONSE TO INVITATION NO. 55103 MAY BE DISREGARDED, IN VIEW OF THE BIDDER'S ALLEGATION OF ERROR.

ON THE BASIS OF THE FACTS AND EVIDENCE OF RECORD, INCLUDING THE CORPORATION'S EXPLANATORY LETTER OF OCTOBER 20, 1955, ITS ORIGINAL WORKSHEET FURNISHED IN SUPPORT OF ITS ALLEGATION OF ERROR AND THE ABSTRACT OF ALL BIDS RECEIVED, THERE APPEARS TO BE NO DOUBT THAT A BONA FIDE ERROR WAS MADE BY THE CORPORATION IN COMPUTING ITS BID PRICE.

ACCORDINGLY, SINCE THE FRANK E. EWING COMPANY, INC., ADVISED OF AN ERROR IN ITS BID PROMPTLY AFTER THE OPENING AND ESTABLISHED PRIOR TO AWARD THAT ITS BID WAS ERRONEOUS, THE COMPANY'S BID SHOULD BE DISREGARDED.

THE PAPERS, WITH THE EXCEPTION OF THE BIDDER'S LETTER OF OCTOBER 20, 1955, ITS WORKSHEET AND THE ABSTRACT OF BIDS, ARE RETURNED.
