B-125879, FEB. 7, 1956

TO MR. EVERETTE B. WILHOIT:

REFERENCE IS MADE TO YOUR LETTER DATED SEPTEMBER 21, 1955, CONCERNING YOUR CLAIM FOR ARREARS OF PAY BELIEVED TO BE DUE FOR THE PERIOD MARCH 1951, THROUGH OCTOBER 1951, INCIDENT TO YOUR SERVICE AS AN ENLISTED MAN,UNITED STATES ARMY.

BY OUR SETTLEMENT DATED MAY 28, 1954, YOU WERE ALLOWED THE SUM OF $85 REPRESENTING REFUND OF CLASS Q ALLOTMENT IN THAT AMOUNT WHICH HAD BEEN DEDUCTED IN YOUR PAY ACCOUNT FOR MAY 1951. YOU WERE ALSO ADVISED THAT AN EXAMINATION OF YOUR PAY ACCOUNT FOR THE PERIOD JANUARY 1951, THROUGH OCTOBER 21, 1952, THE DATE OF YOUR DISCHARGE, REVEALED NO OTHER UNPAID CREDITS. LATER, OUR CLAIMS DIVISION BY LETTER DATED MARCH 10, 1955, FURNISHED YOU A CONSOLIDATED STATEMENT OF YOUR PAY ACCOUNT SHOWING ALL CREDITS AND DEBITS FOR THE PERIOD JANUARY 1, 1951, THROUGH OCTOBER 21, 1952. IN THE LETTER OF SEPTEMBER 21, 1955, IT IS INDICATED THAT YOU BELIEVE THAT THE STATEMENT OF ACCOUNTS WAS INCORRECT.

A REEXAMINATION OF YOUR PAY ACCOUNT FOR THE ENTIRE PERIOD OF YOUR MILITARY SERVICE, THAT IS, FROM NOVEMBER 13, 1950, THROUGH OCTOBER 21, 1952, SHOWS THAT YOU WERE PROPERLY CREDITED WITH ALL ITEMS TO WHICH YOU WERE ENTITLED THAT ALL DEBIT ITEMS EXCEPT THE SUM OF $85 ALLOWED BY THE SETTLEMENT OF MAY 28, 1954, WERE PROPERLY CHARGEABLE AGAINST YOUR ACCOUNT. IT APPEARS FROM YOUR PREVIOUS LETTERS THAT YOU ARE OF THE OPINION THAT AN AMOUNT IS DUE YOU ON ACCOUNT OF AN ERRONEOUS DEDUCTION FROM YOUR PAY FOR ABSENCE WITHOUT LEAVE. YOUR PAY RECORD FOR THE PERIOD JANUARY 1 TO JUNE 30, 1951, SHOWS THAT THERE WAS CHARGED AGAINST YOUR ACCOUNT THE SUM OF $137.50 ON ACCOUNT OF ABSENCE WITHOUT LEAVE FOR THE PERIOD MARCH 26 TO MAY 20, 1951. THAT SUM, HOWEVER, WAS RECREDITED TO YOUR ACCOUNT DURING THE PERIOD JULY 1 TO DECEMBER 31, 1951, ON THE BASIS THAT YOU WERE ERRONEOUSLY REPORTED AS HAVING BEEN ABSENT WITHOUT LEAVE. NO OTHER CHARGES FOR ABSENCE WITHOUT LEAVE WERE MADE DURING THE PERIOD OF YOUR SERVICE AND, AS STATED ABOVE, THE RECORD SHOWS THAT YOU HAVE BEEN PAID THE ENTIRE AMOUNT DUE.

RESPECTING YOUR REQUEST THAT YOU BE SENT COPIES OF YOUR PAY RECORD YOU ARE ADVISED THAT SINCE THE LETTER OF MARCH 10, 1955, FURNISHED DETAILED INFORMATION AS DISCLOSED BY THE RECORDS, NO USEFUL PURPOSE WOULD APPEAR TO BE SERVED BY FURNISHING YOU COPIES OF THE RECORDS. ACCORDINGLY, YOUR REQUEST FOR SUCH COPIES IS DENIED, IN THE ABSENCE OF A CLEAR SHOWING OF YOUR NEED FOR THEM AND THE PURPOSE FOR WHICH THEY ARE TO BE USED, TOGETHER WITH A REMITTANCE TO COVER THE COST OF PREPARING THE COPIES.
