REFERENCE IS MADE TO YOUR LETTER DATED DECEMBER 23, 1954, REQUESTING REVIEW OF THE SETTLEMENT DATED OCTOBER 19, 1954, IN CLAIM NO. TK 416926, WHICH DISALLOWED YOUR SUPPLEMENTAL BILL IN THE AMOUNT OF $61.31, FOR ADDITIONAL CHARGES ALLEGED TO BE DUE FOR THE TRANSPORTATION OF A SHIPMENT OF INTERNAL COMBUSTION ENGINES WEIGHING 4,984 POUNDS, FROM BROOKLEY, ALABAMA, TO HANCOCK FIELD, SYRACUSE, NEW YORK, UNDER BILL OF LADING NO. WV -2648114.

THIS SHIPMENT WAS TENDERED TO THE ATLANTA-NEW ORLEANS MOTOR FREIGHT COMPANY AT BROOKLEY ON DECEMBER 28, 1951, WITH INSTRUCTIONS TO FORWARD IT TO SYRACUSE VIA "ATLANTA NEW ORLEANS MTR FRT CO) ASSOCIATED.' DELIVERY WAS ACCOMPLISHED BY BOSS LINCO LINES, INC., HOWEVER, AND, AS A RESULT, YOUR COMPANY NOW CLAIMS CHARGES BASED ON THE USE OF A COMBINATION OF RATES.

THE TRANSPORTATION CHARGES APPLICABLE VIA THE ROUTE DESIGNATED ON THE BILL OF LADING WERE $161.48, BEING COMPUTED ON THE BASIS OF A SECOND-CLASS RATE OF 324 CENTS PER 100 POUNDS, AS AUTHORIZED BY SOUTHERN MOTOR CARRIERS RATE CONFERENCE TARIFF NO. 4-G, MF-I.C.C. NO. 514. THERE WAS ALSO AN ESTABLISHED THROUGH ROUTE FROM THE POINT OF ORIGIN TO THE POINT OF DESTINATION VIA ATLANTA-NEW ORLEANS MOTOR FREIGHT COMPANY TO ATLANTA, GEORGIA, THENCE ASSOCIATED TRANSPORT, INC., OVER WHICH ROUTE THE INITIAL CARRIER JOINED WITH ITS CONNECTION IN THE ESTABLISHMENT OF THROUGH RATES, AS AUTHORIZED BY ITEM 560, SOUTHERN MOTOR CARRIERS RATE CONFERENCE TARIFF NO. 151-D, MF-I.C.C. NO. 526. SINCE THE CARRIERS PARTICIPATING IN THE SINGLE FACTOR THROUGH RATE WERE DESIGNATED ON THE BILL OF LADING BY THE GOVERNMENT SHIPPING OFFICER, THERE WAS NO AUTHORITY FOR PARTICIPATION IN THE HAUL BY ANY OTHER CARRIER OR FOR THE COLLECTION OF ANY CHARGES IN EXCESS OF THOSE BASED ON SUCH THROUGH RATE WHICH YOU CLAIMED AND WERE PAID IN THE FIRST INSTANCE.
