REFERENCE IS MADE TO YOUR TELEGRAM AND LETTER OF OCTOBER 12, 1955, ACKNOWLEDGED ON OCTOBER 19, PROTESTING THE ACTION OF THE DEPARTMENT OF THE ARMY IN REFUSING TO ACCEPT YOUR TELEGRAPHIC BID ON CERTAIN SURPLUS PROPERTY OF THE GOVERNMENT OFFERED ON INVITATION NO. 36-061-S-56-5. YOUR LETTER OF OCTOBER 25, WITHDREW THE PROTEST INASMUCH AS YOUR BID WAS NOT THE HIGHEST ONE RECEIVED BUT YOU REQUEST OUR OPINION ON THE QUESTION OF THE PROPRIETY OF YOUR TELEGRAPHIC BID.

GENERALLY, TELEGRAPHIC BIDS ARE CONSIDERED ONLY WHEN THE INVITATION SPECIFICALLY PERMITS THEIR SUBMISSION. WITH RESPECT TO SALES INVITATIONS ISSUED BY THE DEPARTMENT OF THE ARMY, ARMY REGULATION 755 7, PARAGRAPH 34D, STATES THAT "TELEGRAPHIC BIDS WILL NOT BE ACCEPTABLE.' THEREFORE, THE PITTSBURGH ORDNANCE DISTRICT, WHICH ISSUED THE INVITATION, WAS NOT AUTHORIZED TO ACCEPT A TELEGRAPHIC BID.
