PUBLIC PRINTER: REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 21. ERROR IS APPARENT ON THE FACE OF THE CORPORATION'S BID SINCE ITS PRICE PER THOUSAND MULTIPLIED BY THE QUANTITY INVOLVED DOES NOT EQUAL $2. THE CORPORATION ADVISED THAT A TYPOGRAPHICAL ERROR WAS MADE IN SUBMITTING THE BID IN THAT THE INTENDED PRICE WAS $28.10 PER THOUSAND FOR THE SPECIFIED QUANTITY AND $27.90 PER THOUSAND FOR ADDITIONAL SETS. ITS ORIGINAL WORKSHEET ON WHICH THE BID PRICE WAS COMPUTED REASONABLY SUBSTANTIATES THE ALLEGATION OF ERROR. THERE APPEARS NO DOUBT THAT A BONA FIDE ERROR WAS MADE IN THE BID AS ALLEGED BY THE BIDDER. SINCE THE CONTRACTING OFFICER BELIEVED THE BID WAS ERRONEOUS AND SUCH BELIEF WAS CONFIRMED PRIOR TO AWARD.

REFERENCE IS MADE TO YOUR LETTER OF SEPTEMBER 21, 1955, WITH ENCLOSURES, RELATIVE TO AN ALLEGED ERROR IN A BID DATED SEPTEMBER 10, 1955, SUBMITTED BY BUSINESS FORMS MFG. CORPORATION FOR FURNISHING FORMS IN ACCORDANCE WITH THE SPECIFICATIONS ON JACKET NO. 356675.

ERROR IS APPARENT ON THE FACE OF THE CORPORATION'S BID SINCE ITS PRICE PER THOUSAND MULTIPLIED BY THE QUANTITY INVOLVED DOES NOT EQUAL $2,572 AS EXTENDED TO THE AMOUNT COLUMN. YOU STATE THAT THE CONTRACTING OFFICER TOOK NOTICE THEREOF UPON EXAMINING THE BIDS AND REQUESTED THE BIDDER TO REVIEW THE SPECIFICATIONS AND CONFIRM THE PRICE IT QUOTED. BY LETTER DATED JULY 15, 1955, CONFIRMING PRIOR TELEPHONE CONVERSATION,THE CORPORATION ADVISED THAT A TYPOGRAPHICAL ERROR WAS MADE IN SUBMITTING THE BID IN THAT THE INTENDED PRICE WAS $28.10 PER THOUSAND FOR THE SPECIFIED QUANTITY AND $27.90 PER THOUSAND FOR ADDITIONAL SETS, INSTEAD OF $18.10 AND $17.90, RESPECTIVELY, AS QUOTED IN ITS BID. ITS ORIGINAL WORKSHEET ON WHICH THE BID PRICE WAS COMPUTED REASONABLY SUBSTANTIATES THE ALLEGATION OF ERROR.

THERE APPEARS NO DOUBT THAT A BONA FIDE ERROR WAS MADE IN THE BID AS ALLEGED BY THE BIDDER. ACCORDINGLY, SINCE THE CONTRACTING OFFICER BELIEVED THE BID WAS ERRONEOUS AND SUCH BELIEF WAS CONFIRMED PRIOR TO AWARD, THE BID OF BUSINESS FORMS MFG. CORPORATION SHOULD BE DISREGARDED IN MAKING THE AWARD.
