YOU STATE THAT WHEN THE BIDS WERE EXAMINED BY THE CONTRACTING OFFICER IT WAS NOTED THAT THE BID OF DITTLER BROTHERS. 712 WAS POSSIBLY IN ERROR SINCE IT WAS OUT OF LINE WITH THE EIGHT OTHER BIDS. WAS REQUESTED TO REVIEW THE SPECIFICATIONS AND TO CONFIRM ITS BID PRICE. THAT IN COMPUTING ITS BID IT UNDERESTIMATED THE PAPER TONNAGE AND THAT THE CORRECT PRICE FOR THE FORMS IS $2.23 PER ONE THOUSAND OR A TOTAL PRICE OF $8. WHEREAS IT SHOULD HAVE USED 34 BY 44 - 80 (20 POUND BASIS). THAT THE CORRECT PAPER WEIGHT REQUIRED FOR THE JOB IS 38. THERE IS NO ROOM FOR DOUBT THAT AN ERROR WAS MADE BY THE CORPORATION. SINCE IT WAS BELIEVED THAT THE BID WAS ERRONEOUS AND SUCH BELIEF WAS CONFIRMED PRIOR TO AWARD.

REFERENCE IS MADE TO YOUR LETTER OF AUGUST 2, 1955, WITH ENCLOSURES, REQUESTING A DECISION AS TO THE ACTION TO BE TAKEN REGARDING AN ERROR DITTLER BROTHERS, INC., ALLEGES IT MADE IN ITS BID FOR FURNISHING 3,808,000 FORMS.

YOU STATE THAT WHEN THE BIDS WERE EXAMINED BY THE CONTRACTING OFFICER IT WAS NOTED THAT THE BID OF DITTLER BROTHERS, INC., OF $5,712 WAS POSSIBLY IN ERROR SINCE IT WAS OUT OF LINE WITH THE EIGHT OTHER BIDS, IN AMOUNTS RANGING FROM $7,920.64 TO $10,852.80, AND WITH THE GOVERNMENT PRINTING OFFICE'S ESTIMATE OF $8,029.36 FOR PERFORMING THE WORK. THE CORPORATION, THEREFORE, WAS REQUESTED TO REVIEW THE SPECIFICATIONS AND TO CONFIRM ITS BID PRICE. IN RESPONSE, THE CORPORATION ADVISED BY TELEGRAM DATED JULY 28, 1955, THAT IN COMPUTING ITS BID IT UNDERESTIMATED THE PAPER TONNAGE AND THAT THE CORRECT PRICE FOR THE FORMS IS $2.23 PER ONE THOUSAND OR A TOTAL PRICE OF $8,491.84 FOR THE REQUIRED QUANTITY. IN A CONFIRMING LETTER OF THE SAME DATE, THE CORPORATION STATED THAT ITS ESTIMATING DEPARTMENT ERRED IN THE "BASIS WEIGHT" OF THE PAPER BY USING SHEET SIZE 34 BY 44 - 40 (20 POUND BASIS), WHEREAS IT SHOULD HAVE USED 34 BY 44 - 80 (20 POUND BASIS); AND THAT THE CORRECT PAPER WEIGHT REQUIRED FOR THE JOB IS 38,400 POUNDS AND NOT 19,200 POUNDS AS ORIGINALLY COMPUTED BY IT. IN SUPPORT OF ITS ALLEGATION OF ERROR, THE CORPORATION SUBMITTED ITS ESTIMATE SHEET.

ON THE BASIS OF THE FACTS AND EVIDENCE OF RECORD, THERE IS NO ROOM FOR DOUBT THAT AN ERROR WAS MADE BY THE CORPORATION, AS ALLEGED. ACCORDINGLY, SINCE IT WAS BELIEVED THAT THE BID WAS ERRONEOUS AND SUCH BELIEF WAS CONFIRMED PRIOR TO AWARD, THE BID OF DITTLER BROTHERS, INC., SHOULD BE DISREGARDED.

THE CORPORATION'S LETTER OF JULY 28, 1955, AND ITS ESTIMATE SHEET ARE BEING RETAINED. THE OTHER PAPERS ARE RETURNED.
