WE ARE IN RECEIPT OF A LETTER FROM THE HONORABLE OLIN D. JOHNSTON, UNITED STATES SENATE, REQUESTING CONSIDERATION OF THE CLAIM OF MR. JAMES J. TONEY, 725 2ND STREET, N.W., WASHINGTON, C., FOR REFUND OF THE AMOUNT OF $290.27, PREVIOUSLY WITHHELD FROM HIS RETIREMENT ANNUITY FOR THE PERIOD JULY 1, 1954, TO SEPTEMBER 30, 1954.

THE DEDUCTION APPARENTLY WAS OCCASIONED BY THE CONTINUED RECEIPT OF A DISABILITY RETIREMENT ANNUITY BY MR. TONEY FOR A PERIOD AFTER HE HAD BEEN REEMPLOYED, ON MARCH 3, 1947, WITH THE BUREAU OF PUBLIC ROADS. THE CASE IS IDENTIFIED AS CSA 367170. THE ANNUITANT SEEKS RELIEF UNDER THE PROVISIONS OF THE ACT OF AUGUST 28, 1954, PUBLIC LAW 684, 83D CONGRESS, 68 STAT. 890, WHICH CANCELS ALL CLAIMS BY THE UNITED STATES INVOLVING RECEIPT OF DUAL COMPENSATION WHICH ARE NOT REPORTED TO THE GENERAL ACCOUNTING OFFICE FOR COLLECTION WITHIN 6 YEARS FROM THE LAST DATE OF ANY PERIOD OF DUAL COMPENSATION.

IN ORDER THAT WE MAY BE IN POSSESSION OF THE INFORMATION NECESSARY TO A PROPER REPLY TO SENATOR JOHNSTON AND TO CONSIDER THE MERITS OF THE CLAIMANT'S REQUEST FOR RELIEF, A DETAILED REPORT OF THE FACTS IS REQUESTED, TOGETHER WITH YOUR RECOMMENDATION AS TO THE APPLICABILITY OF THE REFERRED-TO STATUTE TO THIS MATTER.
