INC.: FURTHER REFERENCE IS MADE TO YOUR LETTER OF MAY 4. IN THE REPORT IT IS STATED. DETERMINED THAT THE TERMINATION WAS PROPER AND IN THE BEST INTERESTS OF THE AIR FORCE. IT IS STATED FURTHER THAT THE AIR FORCE HAS MADE A COMPLETE REVIEW AND REEXAMINATION OF THE MATTER. ALTHOUGH THE PROCUREMENT ACTION WAS TAKEN ON THE BASIS OF POORLY PREPARED AND INADEQUATELY REVIEWED REQUIREMENTS. IT IS STATED IN THE REPORT THAT THE DECISION TO TERMINATE WAS BASED ON A DETERMINATION THAT THE LEMPCO NDG GRINDER. WHICH IS A HAND-FED AND HAND- HELD TYPE. ALTHOUGH THIS GRINDER IS ADEQUATE FOR GRINDING ENGINE COMPONENTS OF IN- LINE ENGINES. IT WAS CONSIDERED BY AIR FORCE MAINTENANCE ENGINEERING PERSONNEL AS NOT SUITABLE FOR HANDLING ALL TYPES OF ENGINE BLOCKS.

FURTHER REFERENCE IS MADE TO YOUR LETTER OF MAY 4, 1955, ACKNOWLEDGED MAY 16, PROTESTING THE CANCELLATION OF YOUR CONTRACT NO. AF 09/603/-31045 DATED DECEMBER 23, 1954, FOR FURNISHING 211 GRINDERS, LEMPCO MODEL NDG, TO THE DEPARTMENT OF THE AIR FORCE.

IN RESPONSE TO A REQUEST BY THIS OFFICE, THE DEPARTMENT OF THE AIR FORCE HAS FURNISHED A REPORT SETTING OUT THE REASONS FOR CANCELLATION OF THE CONTRACT. IN THE REPORT IT IS STATED, IN SUBSTANCE, THAT IN RESPONSE TO YOUR PROTEST AND AFTER CONFERENCES WITH YOUR REPRESENTATIVES THE WARNER ROBINS AIR MATERIEL AREA AND THE COMMANDER OF HEADQUARTERS, AIR MATERIEL COMMAND, DETERMINED THAT THE TERMINATION WAS PROPER AND IN THE BEST INTERESTS OF THE AIR FORCE. IT IS STATED FURTHER THAT THE AIR FORCE HAS MADE A COMPLETE REVIEW AND REEXAMINATION OF THE MATTER, INCLUDING AN INVESTIGATION BY THE OFFICE OF SPECIAL INVESTIGATIONS, AND THAT THERE APPEARS NO GROUND FOR DOUBT AS TO ANY DISCRIMINATION OR IRREGULAR PRACTICE ON THE PART OF AIR FORCE PERSONNEL IN CONNECTION WITH THIS MATTER, ALTHOUGH THE PROCUREMENT ACTION WAS TAKEN ON THE BASIS OF POORLY PREPARED AND INADEQUATELY REVIEWED REQUIREMENTS.

WITH RESPECT TO THE ACTUAL REASONS FOR TERMINATION OF YOUR CONTRACT, IT IS STATED IN THE REPORT THAT THE DECISION TO TERMINATE WAS BASED ON A DETERMINATION THAT THE LEMPCO NDG GRINDER, WHICH IS A HAND-FED AND HAND- HELD TYPE, WOULD NOT MEET THE LONG RANGE REQUIREMENTS OF THE AIR FORCE. ALTHOUGH THIS GRINDER IS ADEQUATE FOR GRINDING ENGINE COMPONENTS OF IN- LINE ENGINES, IT WAS CONSIDERED BY AIR FORCE MAINTENANCE ENGINEERING PERSONNEL AS NOT SUITABLE FOR HANDLING ALL TYPES OF ENGINE BLOCKS, HEADS, ETC., PARTICULARLY WHERE DIESEL AND V-8-TYPE ENGINE COMPONENTS ARE CONCERNED--- A CONSIDERATION REGARDED AS OF MAJOR IMPORTANCE IN VIEW OF THE TREND TO V-8-TYPE ENGINES IN THE AUTOMOTIVE INDUSTRY AND THE FACT THAT THE GRINDERS HAVE AN ANTICIPATED LIFE OF 20 YEARS.

THE FOLLOWING PARAGRAPH OF THE REPORT IS QUOTED AS SETTING OUT THE PRESENT NEED AND POLICY OF THE AIR FORCE WITH RESPECT TO SUCH GRINDERS AS THOSE COVERED BY YOUR CONTRACT:

"REVIEW OF THE QUANTITATIVE REQUIREMENTS DISCLOSED THAT THE ORIGINAL PURCHASE REQUESTS WERE BASED ON COMPUTATIONS DEVELOPED BY THE DIRECTORATE OF SUPPLY AND SERVICES, WARNER ROBINS AIR MATERIEL AREA, PRIMARILY TO SATISFY INDICATED REQUIREMENTS AT FIELD MAINTENANCE LEVEL. UNDER THE AIR FORCE MOTOR VEHICLE MAINTENANCE PROGRAM, EQUIPMENT COMPONENT LIST (ECL) 20 -47-1, DATED 17 FEBRUARY 1954, AUTHORIZED ONE EACH GRINDER--- HEAVY DUTY WET SURFACE, STOCK NUMBER 8100 354651, AT BOTH FIELD MAINTENANCE AND AIR DEPOT WING LEVELS. HOWEVER, PRIOR TO SATISFYING OUTSTANDING REQUISITIONS SUBMITTED IN ACCORDANCE WITH THE ECL, THE AIR FORCE PLACED STRONGER EMPHASIS ON THE POLICY OF CONTRACTING FOR MAJOR MAINTENANCE WORK WITH COMMERCIAL SOURCES WHICH ELIMINATED THE REQUIREMENT FOR GRINDERS AT FIELD MAINTENANCE LEVEL. EQUIPMENT COMPONENT LIST (ECL) 20-47-1 HAS ACCORDINGLY BEEN REVISED UNDER DATE OF 25 APRIL 1955 TO AUTHORIZE THIS GRINDER AT AIR DEPOT WING LEVEL ONLY. ALTHOUGH THIS GRINDER IS AUTHORIZED AT DEPOT LEVEL, A SURVEY OF AIR FORCE DEPOTS DISCLOSED THERE ARE NO ADDITIONAL REQUIREMENTS AT THIS TIME.'

IN VIEW OF THE FOREGOING, THERE APPEARS NO PROPER BASIS UPON WHICH WE WOULD BE WARRANTED IN ..END :
