AMONG THE PAPERS SUBMITTED IS A PHOTOSTATIC COPY OF A DECREE OF THE COURT OF FIRST INSTANCE OF ATHENS (GREECE) PUBLISHED ON JANUARY 28. THERE WAS ALSO SUBMITTED THE OFFICER'S DEPENDENCY CERTIFICATE (DD FORM 137) WHICH RELATES THAT THE CHILD WAS BORN ON AUGUST 4. IT ALSO RELATES THAT THE OFFICER CONTRIBUTES $100 A MONTH FOR THE SUPPORT OF THE CHILD AND THAT THE CHILD IS NOT POSSESSED OF PROPERTY OR INCOME ADEQUATE FOR HIS SUPPORT. APPEARS THAT THE CHILD'S SURVIVING NATURAL PARENT (FATHER) CANNOT READ OR WRITE AND THEREFORE IS UNABLE TO PREPARE AND EXECUTE THE STATEMENT CONCERNING THE DEPENDENCY STATUS OF THE CHILD AS REQUIRED BY THE NAVY COMPTROLLER MANUAL TO BE SUBMITTED WITH AN OFFICER'S CLAIM FOR INCREASED ALLOWANCES ON ACCOUNT OF AN ADOPTED CHILD RESIDING WITH THE OFFICER.

YOUR LETTER OF MARCH 31, 1955, REQUESTS AN ADVANCE DECISION WHETHER LIEUTENANT GUY E. THOMPSON, 339 052, USN, MAY BE CREDITED WITH A BASIC ALLOWANCE FOR QUARTERS ON ACCOUNT OF AN ADOPTED CHILD (STELIOS IONNIS SITTAS) ON AND AFTER JANUARY 28, 1955.

AMONG THE PAPERS SUBMITTED IS A PHOTOSTATIC COPY OF A DECREE OF THE COURT OF FIRST INSTANCE OF ATHENS (GREECE) PUBLISHED ON JANUARY 28, 1955, AND DECLARING STELIOS IONNIS SITTAS (STELLIOS SYTTAS, THE SON OF IOANNIS), AGE 15, TO BE THE ADOPTIVE SON OF GUY EGHBERT THOMPSON (GAY EGBERT CHARLES THOMSON) PURSUANT TO THE LAWS OF THE STATE OF CONNECTICUT AND THE KINGDOM OF GREECE. THERE WAS ALSO SUBMITTED THE OFFICER'S DEPENDENCY CERTIFICATE (DD FORM 137) WHICH RELATES THAT THE CHILD WAS BORN ON AUGUST 4, 1939, AND THAT THE CHILD RESIDES WITH THE OFFICER. IT ALSO RELATES THAT THE OFFICER CONTRIBUTES $100 A MONTH FOR THE SUPPORT OF THE CHILD AND THAT THE CHILD IS NOT POSSESSED OF PROPERTY OR INCOME ADEQUATE FOR HIS SUPPORT. HOWEVER, IT APPEARS ALSO FROM THE SUBMITTED COURT DECREE THAT THE CHILD IS COMPLETELY INDIGENT.

ON THE EVIDENCE SUBMITTED, THE OFFICER WILL BE CONSIDERED TO HAVE A DEPENDENT (ADOPTED MINOR CHILD) WITHIN THE MEANING OF SECTION 102 (G) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 804, AND PAYMENT TO HIM OF AN INCREASED BASIC ALLOWANCE FOR QUARTERS AS AN OFFICER WITH A DEPENDENT IS AUTHORIZED, PROVIDED THE ALLOWANCE IS OTHERWISE PAYABLE, BEGINNING JANUARY 28, 1955, AND FOR SUCH TIME AS THERE IS NO CHANGE IN THE DEPENDENCY STATUS OF THE CHILD.

THE DEPENDENCY CERTIFICATE (DD FORM 137) AND SUPPORTING PAPERS ARE RETURNED. SUCH EVIDENCE, TOGETHER WITH THIS DECISION, OR A COPY, SHOULD BE INCLUDED IN THE ACCOUNT WHERE CREDIT FOR THE PAYMENTS AUTHORIZED IS FIRST CLAIMED.
