REFERENCE IS MADE TO YOUR LETTER OF MARCH 1, 1955, REFERENCE FC 1070-THP, REQUESTING RECONSIDERATION OF GENERAL ACCOUNTING OFFICE SETTLEMENT DATED FEBRUARY 21, 1955, WHICH DISALLOWED YOUR CLAIM FOR AN ADDITIONAL AMOUNT ALLEGED TO BE DUE AS REIMBURSEMENT FOR EXPENSES INCURRED INCIDENT TO TRAVEL FROM CAIRO, EGYPT, TO WASHINGTON, D.C., AS AM EMPLOYEE OF THE DEPARTMENT OF STATE.

BY DEPARTMENT OF STATE TRAVEL ORDER DATED JULY 7, 1953, YOU WERE AUTHORIZED TO TRAVEL FROM CAIRO, TO WASHINGTON, D.C., UPON TERMINATION OF AN INTER-SERVICE ASSIGNMENT. THE ORDER ALSO AUTHORIZED TRANSPORTATION OF YOUR FAMILY, HOUSEHOLD EFFECTS AND APPLICABLE PER DIEM. THE RECORDS SHOW THAT YOU AND YOUR DEPENDENTS PERFORMED THE TRAVEL DURING THE PERIOD AUGUST TO OCTOBER 1953. THE RECORD SHOWS FURTHER THAT UPON ARRIVAL IN NEW YORK ON SEPTEMBER 3, 1953, YOU TRANSMITTED SOME OF YOUR BAGGAGE (STEAMER TRUNK AND SMALL FOOT LOCKER) TO WASHINGTON, D.C., FOR STORAGE AND PROCEEDED ON ANNUAL LEAVE TO SEATTLE, WASHINGTON. DURING THE PERIOD OF YOUR LEAVE THE HOUSEHOLD EFFECTS WERE ALSO PLACED IN STORAGE IN WASHINGTON, D.C. YOU WERE ALLOWED REIMBURSEMENT OF PER DIEM FOR TRAVEL BY DIRECT ROUTE FROM CAIRO, EGYPT, TO WASHINGTON, D.C., BASED UPON CONSTRUCTIVE SCHEDULE AUTHORIZING DEPARTURE FROM CAIRO AT 8:45 A.M., AUGUST 23, 1953. SINCE YOU DID NOT FURNISH RECEIPTS AS EVIDENCE THAT FIRST-CLASS ACCOMMODATIONS WERE SECURED AND USED BETWEEN NEW YORK AND WASHINGTON, D.C., YOU WERE ALLOWED THE CONSTRUCTIVE COST OF TRAVEL BY COACH. YOU ALSO WERE DENIED REIMBURSEMENT OF THE COST OF STORAGE OF BAGGAGE ($18) AS THERE WAS NO SHOWING THAT SUCH CHARGES WERE INCURRED SOLELY ON ACCOUNT OF OFFICIAL BUSINESS. PAYMENT OF THE AMOUNT CLAIMED FOR STORAGE OF HOUSEHOLD GOODS ($86) WAS DENIED, ON THE GROUNDS THAT THERE IS NO PROVISION IN THE FOREIGN SERVICE TRAVEL REGULATIONS FOR REIMBURSEMENT OF STORAGE CHARGES AND EXPENSES INCIDENT THERETO IN CONNECTION WITH TERMINATIONS, RESIGNATIONS, ETC.

SINCE THE TRAVEL WAS PERFORMED BY YOU AND YOUR DEPENDENTS DURING THE TOURIST SEASON IT REASONABLY MAY BE CONCLUDED THAT YOU ARE ENTITLED TO ADDITIONAL PER DIEM FOR TRAVEL BY AIR AND BOAT, FROM CAIRO TO NEW YORK OF YOURSELF AND FAMILY BASED UPON THE ACTUAL CAIRO TO NEW YORK OF YOURSELF AND FAMILY BASED UPON THE ACTUAL TIME OF YOUR DEPARTURE ON AUGUST 20, 1953. ALSO, YOU ARE ENTITLED TO REIMBURSEMENT FOR THE DIFFERENCE BETWEEN COACH FARE AND FIRST-CLASS RAIL FROM NEW YORK TO WASHINGTON, D.C.

REGARDING STORAGE OF HOUSEHOLD GOODS NEITHER THE FOREIGN SERVICE ACT OF 1946, 60 STAT. 1027, NOR THE APPLICABLE REGULATIONS PROVIDES FOR THE STORAGE OF EFFECTS AT GOVERNMENT EXPENSE OR FOR REIMBURSEMENT OF EXPENSES INCURRED INCIDENT TO STORAGE AT THE TERMINATION OF AN EMPLOYEE'S SERVICE WITH THE FOREIGN SERVICE. IT FOLLOWS THAT THE STORAGE CHARGES AND THE CHARGES FOR LABOR IN AND LABOR OUT OF STORAGE- - WHICH ORDINARILY ARE CONSIDERED AS INCIDENTAL TO STORAGE ARE NOT ALLOWABLE. IN THE EVENT, HOWEVER, FACTUAL INFORMATION IS FURNISHED SHOWING THAT THE LABOR IN CHARGES IN YOUR CASE WERE NOT INCIDENTAL TO THE STORAGE THAT ITEM WILL BE RECONSIDERED UPON YOUR REQUEST. PAYMENT OF THE AMOUNT CLAIMED FOR STORAGE OF BAGGAGE CANNOT BE AUTHORIZED AS IT IS APPARENT THE STORAGE WAS INCIDENT TO TAKING ANNUAL LEAVE AND NOT ON ACCOUNT OF OFFICIAL BUSINESS.
