YOUR LETTER OF FEBRUARY 23, 1955, REQUESTS AN ADVANCE DECISION WHETHER LIEUTENANT COMMANDER EVERETT W. LARGE, 303856, USN, MAY BE CREDITED WITH A BASIC ALLOWANCE FOR QUARTERS ON ACCOUNT OF AN ADOPTED CHILD (BARBARA ANN LARGE) ON AND AFTER JANUARY 20, 1955.

AMONG THE PAPERS SUBMITTED ARE A CERTIFIED COPY OF AN ORDER OF ADOPTION, DATED APRIL 29, 1944, IN THE CIRCUIT COURT OF THE NINTH JUDICIAL CIRCUIT OF FLORIDA, IN AND FOR BREVARD COUNTY, IN THE MATTER OF THE ADOPTION OF BARBARA ANN BABCOCK (CHANGED BY THE ORDER TO BARBARA ANN LARGE) BY EVERETT W. LARGE, AND A CERTIFIED COPY OF A FINAL DECREE OF DIVORCE ENTERED ON JANUARY 20, 1955, IN THE CIRCUIT COURT OF FLORIDA, FOURTH JUDICIAL CIRCUIT, IN AND FOR DUVAL COUNTY, IN THE CASE OF JULIA E. LARGE, PLAINTIFF V. EVERETT W. LARGE, DEFENDANT, GRANTING THE PLAINTIFF A FINAL DIVORCE FROM THE DEFENDANT, AWARDING THE CARE, CUSTODY AND CONTROL OF BARBARA ANN LARGE TO THE PLAINTIFF, AND PROVIDING THAT THE DEFENDANT PAY TO THE PLAINTIFF THE SUM OF $120 A MONTH FOR THE SUPPORT AND MAINTENANCE OF THE CHILD. WITH YOUR FIRST ENDORSEMENT OF MAY 10, 1955, THERE WERE SUBMITTED THE OFFICER'S DEPENDENCY CERTIFICATE (DD FORM 137) AND A STATEMENT EXECUTED BY JULIA E. LARGE, WHICH RELATE THAT THE CHILD WAS BORN ON JULY 13, 1939, AND THAT SHE RESIDES WITH HER MOTHER. THEY ALSO RELATE THAT THE OFFICER REGULARLY CONTRIBUTES $120 A MONTH FOR THE SUPPORT, MAINTENANCE, AND EDUCATION OF THE CHILD AND THAT SHE HAS NO OTHER INCOME.

ON THE EVIDENCE SUBMITTED, THE OFFICER WILL BE CONSIDERED TO HAVE A DEPENDENT (ADOPTED MINOR CHILD) WITHIN THE MEANING OF SECTION 102 (G) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 804, AND PAYMENT TO HIM OF AN INCREASED BASIC ALLOWANCE FOR QUARTERS AS AN OFFICER WITH A DEPENDENT IS AUTHORIZED, PROVIDED THE ALLOWANCE IS OTHERWISE PAYABLE, BEGINNING JANUARY 20, 1955, AND FOR SUCH TIME AS THERE IS NO MATERIAL CHANGE IN THE DEPENDENCY STATUS OF THE CHILD.

THE DEPENDENCY CERTIFICATE (DD FORM 137) AND SUPPORTING PAPERS ARE RETURNED. SUCH EVIDENCE, TOGETHER WITH THIS DECISION, OR A COPY, SHOULD BE INCLUDED IN THE ACCOUNT WHERE CREDIT FOR THE PAYMENTS AUTHORIZED IS FIRST CLAIMED.
