YOU STATED THAT THE SETTLEMENT OF YOUR CLAIM WAS UNSATISFACTORY AND YOU REQUESTED THAT THE CHECK BE NOT RETURNED TO YOU. REFERENCE IS MADE TO YOUR LETTER DATED OCTOBER 31, 1954, TO THE ADJUTANT GENERAL OF THE ARMY, FORWARDED HERE BY LETTER DATED JANUARY 19, 1955, CONCERNING YOUR CLAIM FOR PAY INCIDENT TO YOUR SERVICE AS AN ENLISTED MAN, ARMY OF THE UNITED STATES.

BY SETTLEMENT OF OUR CLAIMS DIVISION DATED APRIL 12, 1945, YOU WERE ALLOWED THE SUM OF $153.47, REPRESENTING PAY DUE YOU AT THE DATE OF YOUR DISCHARGE, SEPTEMBER 5, 1944. BY LETTER DATED JULY 13, 1945, YOU RETURNED CHECK NO. 7,943,780, DATED APRIL 24, 1945, PAYABLE TO YOU IN THE SUM OF $153.47, IN PAYMENT OF THE AMOUNT ALLOWED BY THE SETTLEMENT. YOU STATED THAT THE SETTLEMENT OF YOUR CLAIM WAS UNSATISFACTORY AND YOU REQUESTED THAT THE CHECK BE NOT RETURNED TO YOU. IN YOUR PRESENT COMMUNICATION YOU CONTEND THAT YOU WERE NOT DISCHARGED UNTIL OCTOBER 3, 1944, AT FORT CUSTER, MICHIGAN.

IT APPEARS FROM THE RECORDS AND A REPORT FURNISHED OUR OFFICE BY THE ADJUTANT GENERAL THAT YOU WERE DISCHARGED FROM THE ARMY OF THE UNITED STATES AT FORT CUSTER, MICHIGAN, ON SEPTEMBER 5, 1944, WITH A CERTIFICATE OF DISABILITY DISCHARGE. THE ADJUTANT GENERAL HAS ALSO REPORTED THAT INFORMATION TO THAT EFFECT HAS BEEN FURNISHED TO YOU ON NUMEROUS OCCASIONS. SINCE THE RECORDS SHOW THAT YOU WERE DISCHARGED ON SEPTEMBER 5, 1944, THERE IS NO BASIS FOR THE ALLOWANCE OF YOUR CLAIM FOR PAY FROM SEPTEMBER 6 TO OCTOBER 3, 1944, THE DATE YOU APPEAR TO HAVE BEEN RELEASED BY THE MANGER OF THE VETERANS ADMINISTRATION FACILITY, FORT CUSTER, MICHIGAN.

SHOULD YOU CHANGE YOUR MIND, AND DECIDE TO TAKE THE CHECK FOR $153.47, THE AMOUNT ALLOWED BY THE SETTLEMENT OF APRIL 12, 1945, YOU SHOULD SO NOTIFY THE CLAIMS DIVISION, GENERAL ACCOUNTING OFFICE, WASHINGTON 25 D.C. THE ACCEPTANCE OF THAT CHECK WOULD NOT AFFECT YOUR RIGHT TO ANY ADDITIONAL AMOUNT DUE YOU IF YOU SHOULD EVER BE ABLE TO PROVE THAT YOU WERE NOT DISCHARGED UNTIL OCTOBER 3, 1944, OR SOME OTHER DATE AFTER SEPTEMBER 5, 1944.
