REFERENCE IS MADE TO YOUR LETTER REQUESTING RECONSIDERATION OF THE DISALLOWANCE, BY A SETTLEMENT DATED DECEMBER 1, 1954, OF YOUR CLAIM FOR REIMBURSEMENT OF EXPENSES, IN THE AMOUNT OF $125.10, FOR THE STORAGE OF YOUR HOUSEHOLD GOODS DURING THE PERIOD JULY 10 TO NOVEMBER 10, 1953, INCIDENT TO OVERSEAS EMPLOYMENT WITH THE DEPARTMENT OF THE AIR FORCE.

BY AN ORDER DATED MAY 5, 1953, AS AMENDED, ISSUED PRIOR TO COMPLETION OF THE OVERSEAS EMPLOYMENT, AND IN CONNECTION WITH A CHANGE OF FOREIGN DUTY STATIONS, THE RETURN OF YOUR HOUSEHOLD GOODS WAS AUTHORIZED AS BEING "IN THE BEST FORESEEABLE INTEREST OF THE GOVERNMENT." THE ORDER FURTHER PROVIDED THAT "SUBSEQUENT MVMT OF HHLD EFFS AT GOVT EXPENSE FROM POINT IN THE LI TO WHICH SHIPPED UNDER AUTH REFERRED TO ABOVE IS NOT AUTHD." PURSUANT TO THAT ORDER, 10,100 POUNDS OF CRATED HOUSEHOLD GOODS WERE SHIPPED TO SAN BERNARDINO, CALIFORNIA, FOR STORAGE - YOUR HOME IN REDLANDS, CALIFORNIA, THEN BEING OCCUPIED. WITH THE COMPLETION OF YOUR OVERSEAS DUTY, REPATRIATION ORDERS WERE ISSUED ON SEPTEMBER 3, 1953, PROVIDING FOR YOUR TRAVEL, THAT OF YOUR FAMILY, AND THE MOVEMENT OF YOUR HOUSEHOLD GOODS NOT PREVIOUSLY RETURNED TO THE UNITED STATES.

THE PROVISIONS OF EXECUTIVE ORDER NO. 9805, PROMULGATED PURSUANT TO THE ADMINISTRATIVE EXPENSES ACT OF 1946, 60 STAT. 806, ARE CONTROLLING IN THE REIMBURSEMENT OF EXPENSES OF STORAGE UPON MOVEMENT OF HOUSEHOLD GOODS TO OR FROM POINTS OUTSIDE THE CONTINENTAL UNITED STATES. SECTION 20 OF THE EXECUTIVE ORDER PROVIDES THAT THERE SHALL BE ALLOWED "THE ACTUAL EXPENSES OF TEMPORARY STORAGE (NOT TO EXCEED THE AUTHORIZED WEIGHT) FOR NOT TO EXCEED SIXTY DAYS ***." THE AUTHORIZED WEIGHT IN YOUR CASE, AS PRESCRIBED BY SECTION 17 OF THE EXECUTIVE ORDER, IS 8,750 POUNDS FOR THE CRATED HOUSEHOLD GOODS.

A REVIEW OF THE CURRENT RECORD OF YOUR CASE DISCLOSES THAT REIMURSEMENT OF THE EXPENSES OF STORAGE CLAIMED IS PROPER TO THE EXTENT AUTHORIZED BY SECTION 20, THAT IS, THE EXPENSES ATTRIBUTABLE TO 60 DAYS' STORAGE OF 8,750 POUNDS OF CRATED HOUSEHOLD GOODS. ACCORDINGLY, A SUPPLEMENTAL SETTLEMENT WILL ISSUE IN YOUR FAVOR FOR THE ADDITIONAL AMOUNT DUE.
