BY LETTER OF JANUARY 11, 1955, FILE NO. 50-24-CH, YOU PROTESTED THE APPLICATION OF THE COMMODITY RATES NAMED IN RAILROAD COMMISSION OF TEXAS MOTOR FREIGHT COMMODITY TARIFF NO. 6-C, TO SHIPMENTS OF MOTOR VEHICLES, TRAILERS, ETC., TRANSPORTED BY YOUR CLIENT, HARRINGTON TRANSPORTATION CO., INC. TARIFF NO. 6-C PUBLISHES RATES, RULES, REGULATIONS AND CHARGES FOR SHIPMENTS OF OIL FIELD EQUIPMENT AND OTHER COMMODITIES, TRANSPORTED BY SPECIALIZED MOTOR CARRIERS BETWEEN POINTS IN TEXAS, WHICH BECAUSE OF SIZE, WEIGHT OR OTHER PHYSICAL CHARACTERISTICS REQUIRE THE USE OF SPECIAL DEVICES, FACILITIES, OR EQUIPMENT FOR LOADING, UNLOADING OR TRANSPORTATION.

IN ACCORDANCE WITH YOUR REQUEST, OUR TRANSPORTATION DIVISION HAS RECONSIDERED THE APPLICATION OF THIS TARIFF, GIVING CONSIDERATION TO YOUR CONTENTIONS AND THE EVIDENCE SUBMITTED WITH YOUR LETTER AND HAS DETERMINED THAT THE COMMODITY RATES PUBLISHED IN THE TARIFF DO NOT APPLY TO THE SHIPMENTS TRANSPORTED BY YOUR CLIENT. THE NOTICES OF OVERPAYMENT, FORMS 1003, PREVIOUSLY ISSUED TO HARRINGTON TRANSPORTATION CO., INC., ARE BEING CANCELLED OR AMENDED TO THE BASIS OF RATES OTHERWISE APPLICABLE.
