LOUIS, MISSOURI, INCIDENT TO YOUR SERVICE AS CHIEF ELECTRONICS TECHNICIAN, UNITED STATES NAVY.

BY ORDERS DATED OCTOBER 12, 1951, YOU WERE DETACHED FROM DUTY AT LAMBERT FIELD, ST. LOUIS, MISSOURI, AND ASSIGNED TO THE UNITED STATES NAVAL AIR STATION, PENSACOLA, FLORIDA, FOR FURTHER ASSIGNMENT TO UNITED STATES NAVAL AIR STATION, GUANTANAMO BAY, CUBA. BY ORDERS DATED AUGUST 25, 1952, YOU WERE TRANSFERRED FROM UNITED STATES NAVAL AIR STATION, QUANTANAMO BAY, CUBA, TO THE UNITED STATES NAVAL RECEIVING STATION, WASHINGTON, D. C., WITH ULTIMATE DESTINATION AIR TRANSPORT SQUADRON TWENTY-FIVE, LONDON, ENGLAND, WHERE YOU REPORTED OCTOBER 15, 1952. YOUR HOUSEHOLD EFFECTS WERE DELIVERED TO COMMERCIAL STORAGE OCTOBER 21, 1952, AT ST. LOUIS, MISSOURI. DELIVERY WAS MADE UNDER GOVERNMENT BILL OF LADING N 29930726 SUPPORTED BY THE ORDERS DATED AUGUST 25, 1952, WHICH DIRECTED DUTY OVERSEAS. THE GOODS WERE REMOVED FROM STORAGE OCTOBER 15, 1953, ON GOVERNMENT BILL OF LADING N 17249789 WHICH COVERED SHIPMENT FROM ST. LOUIS, MISSOURI, TO OLATHE, KANSAS, SUPPORTED BY ORDERS DATED SEPTEMBER 8, 1953, WHICH DIRECTED DUTY ASHORE.

THE REGULATIONS GOVERNING TEMPORARY STORAGE OF HOUSEHOLD EFFECTS AT GOVERNMENT EXPENSE ARE CONTAINED IN PARAGRAPH 8006-1A OF THE JOINT TRAVEL REGULATIONS PROMULGATED PURSUANT TO SECTION 303(C) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 814, WHICH PROVIDES THAT, WHEN NECESSARY IN CONNECTION WITH A PERMANENT CHANGE OF STATION, TEMPORARY STORAGE OF HOUSEHOLD EFFECTS NOT TO EXCEED SIX MONTHS MAY BE AUTHORIZED AT GOVERNMENT EXPENSE, (1) AFTER PICKUP OF PROPERTY AT QUARTERS AND BEFORE DISPATCH FROM CARRIER'S STATION AT POINT OF ORIGIN, (2) WHILE SHIPMENT IS IN TRANSIT OR EN ROUTE AND STORAGE IS NOT FURNISHED FREE BY THE CARRIER, AND (3) AFTER ARRIVAL OF SHIPMENT AT CARRIER'S DESTINATION STATION AND BEFORE DELIVERY OF SHIPMENT INTO QUARTERS. PARAGRAPH 8006 2 OF THE SAME REGULATIONS PROVIDES THAT WHERE STORAGE OF EFFECTS IS DESIRED UPON ASSIGNMENT TO DUTY OUTSIDE THE UNITED STATES, HOUSEHOLD EFFECTS MAY BE PLACED IN NONTEMPORARY STORAGE IN GOVERNMENT FACILITIES WHEN SUCH FACILITIES ARE AVAILABLE. HOWEVER, WHEN SUCH FACILITIES ARE NOT AVAILABLE AND THE EFFECTS ARE PLACED IN COMMERCIAL STORAGE THERE IS NO AUTHORITY FOR PAYMENT OF ANY PORTION OF THE COST INCURRED FOR COMMERCIAL STORAGE. COMP. GEN. 410; 33 ID. 306. PARAGRAPH 8008-2 OF THESE REGULATIONS, TO WHICH YOU REFER, IS APPLICABLE ONLY IN THOSE CASES WHERE A MEMBER IS DETACHED FROM AN OVERSEAS PERMANENT DUTY STATION AND AT THE TIME HIS HOUSEHOLD GOODS ARRIVE AT THE POINT TO WHICH SHIPPED IN THE UNITED STATES ORDERS TO A NEW DUTY STATION ARE NOT AVAILABLE.

ACCORDINGLY, THE DISALLOWANCE OF YOUR CLAIM FOR STORAGE OF YOUR HOUSEHOLD EFFECTS WAS CORRECT AND IS SUSTAINED.
