POSTMASTER GENERAL: REFERENCE IS MADE TO LETTER DATED JUNE 28. THE POSTMASTERS INVOLVED IN THE PHYSICAL LOSS OF THE FUNDS CONCERNED HAVE BEEN RELIEVED OF THE DEFICIENCIES IN THEIR ACCOUNTS. IT IS REPORTED THAT FINANCIAL HARDSHIP WOULD RESULT IF MR. WINLAND WAS REQUIRED TO PAY THE ENTIRE BALANCE OF $752.25 AND YOUR DEPARTMENT RECOMMENDS THAT A COMPROMISE OFFER OF $376.25 BE ACCEPTED PURSUANT TO THE PROVISIONS OF TITLE 5. OUR OFFICE CONCURS IN THE VIEW THAT THERE IS A PROPER BASIS FOR ACCEPTANCE OF THE COMPROMISE OFFER IN THIS CASE.

REFERENCE IS MADE TO LETTER DATED JUNE 28, 1955, FROM THE ASSISTANT POSTMASTER GENERAL AND CONTROLLER, TRANSMITTING THE CASE OF THE INDEBTEDNESS OF MILES B. WINLAND, CONTRACTOR FOR STAR ROUTE NO. 31113, IN THE AMOUNT OF $752.25 ARISING BY REASON OF THE THEFT OF THE MAILS BY AN EMPLOYEE OF THE STAR ROUTE CONTRACTOR.

THE POSTMASTERS INVOLVED IN THE PHYSICAL LOSS OF THE FUNDS CONCERNED HAVE BEEN RELIEVED OF THE DEFICIENCIES IN THEIR ACCOUNTS. IT IS REPORTED THAT FINANCIAL HARDSHIP WOULD RESULT IF MR. IN VIEW OF THE STATEMENTS APPEARING IN THE LETTER OF JUNE 28, 1955, OUR OFFICE CONCURS IN THE VIEW THAT THERE IS A PROPER BASIS FOR ACCEPTANCE OF THE COMPROMISE OFFER IN THIS CASE. SINCE THE RECORDS BEFORE OUR OFFICE INDICATE THAT THE AMOUNT OF $376.25 HAS BEEN RECEIVED AND DEPOSITED, NO FURTHER ACTION APPEARS NECESSARY TO BE TAKEN IN THE MATTER.
