PRECIS-UNAVAILABLE

MR. GEORGE M. AIKEN:

FURTHER REFERENCE IS MADE TO YOUR LETTER OF JANUARY 16, 1954, REQUESTING REVIEW OF SETTLEMENT DATED DECEMBER 31, 1953, WHICH ALLOWED $6.90 ON YOUR CLAIM AS REIMBURSEMENT FOR YOUR DEPENDENT'S TRAVEL FROM CAN BY, MINNESOTA, TO PALM CITY, CALIFORNIA, IN SEPTEMBER 1952.

YOU STATE THAT UPON YOUR DETACHMENT FROM DUTY AT PORTSMOUTH, VIRGINIA, AND TRANSFER TO THE U.S.S. GENESEE, HOME PORT, PEARL HARBOR, HAWAII, YOUR WIFE WAS TRANSPORTED AT GOVERNMENT EXPENSE TO CAN BY. IT APPEARS THAT YOU LATER WERE TRANSFERRED FROM THE U.S.S. GENESEE TO THE U.S.S. QUINCY, HOME YARD, LONG BEACH, CALIFORNIA, AND BE STANDARD TRANSFER ORDER DATED MAY 22, 1952, YOU WERE TRANSFERRED FROM THE LATTER VESSEL TO THE U.S.S. CURRIER, HOME PORT, SAN DIEGO, CALIFORNIA.

PARAGRAPH 7061, JOINT TRAVEL REGULATIONS, PROVIDES FOR TRANSPORTATION OF DEPENDENTS AT GOVERNMENT EXPENSE UPON TRANSFER FROM A SHORE STATION TO A VESSEL WHEN TRAVEL IS FROM THE SHORE STATION TO A PLACE OTHER THAN A HOME YARD OR HOME PORT OF THE VESSEL, AT NOT TO EXCEED ENTITLEMENT FROM THE SHORE STATION TO SUCH HOME YARD OR HOME PORT, WHICHEVER IS GREATER. TRANSPORTATION WAS FURNISHED YOUR WIFE TO CAN BY UNDER SUCH REGULATIONS. PARAGRAPH 7063 AUTHORIZES TRANSPORTATION OF DEPENDENTS AT GOVERNMENT EXPENSE UPON TRANSFER BETWEEN VESSELS WHEN TRAVEL IS FROM A PLACE OTHER THAN THE OLD HOME YARD OR HOME PORT OF THE VESSEL TO THE NEW HOME YARD OR HOME PORT AT "NOT TO EXCEED THE ENTITLEMENT EITHER FROM THE OLD HOME YARD TO THE NEW HOME YARD OF THE VESSEL, OR FROM THE OLD HOME PORT TO THE NEW HOME PORT OF THE VESSEL WHICHEVER IS GREATER." PARAGRAPH 7055 STATES THAT IF A MEMBER, UPON RECEIPT OF PERMANENT CHANGE OF STATION ORDERS, RETAINS HIS DEPENDENTS AT THE PLACE WHERE THEY WERE THEN LOCATED, TRANSPORTATION OF DEPENDENTS IS AUTHORIZED ON SUBSEQUENT CHANGE OF STATION, NOT IN EXCESS OF THE DISTANCE TO SUCH NEW STATION FROM EITHER THE FIRST OR SECOND STATION, WHICHEVER IS GREATER.

SINCE YOU DID NOT MOVE YOUR WIFE TO THE HOME YARD OR HOME PORT OF EITHER THE U.S.S. GENESEE OR THE U.S.S. QUINCY, BUT ELECTED TO HAVE HER REMAIN IN CAN BY UNTIL YOU WERE TRANSFERRED TO THE U.S.S. CURRIER, YOU ARE NOT ENTITLED TO REIMBURSEMENT FOR HER TRAVEL FROM CAN BY TO THE HOME PORT OF THE LATTER VESSEL AT SAN DIEGO. HOWEVER, REIMBURSEMENT IS AUTHORIZED ON A MILEAGE BASIS AT NOT TO EXCEED THE DISTANCE FROM SAN FRANCISCO, CALIFORNIA, PORT OF DEBARKATION FOR TRAVELERS FROM HAWAII - WHERE THE HOME PORT OF THE U.S.S. GENESEE WAS LOCATED - TO SAN DIEGO, AND A SETTLEMENT ALLOWING THE PROPER ADDITIONAL AMOUNT FOUND DUE ON THAT BASIS LESS THE AMOUNT HERETOFORE ALLOWED, WILL ISSUE IN DUE COURSE.

THE CHECK IN THE AMOUNT OF $6.90 ISSUED IN PAYMENT OF THE SETTLEMENT OF DECEMBER 31, 1953, AND WHICH WAS ENCLOSED WITH YOUR LETTER, IS RETURNED HEREWITH.
