Sir:

Under date of May 7, 1940, the Department of the Interior referred to this office, for settlement and the initiation of collection proceedings, an administratively determined indebtedness to the United States of Arthur E. Johnson, Scotland, Arkansas, in the sum of $63, reported to have arisen as follows:

"From a report of field investigation by a special agent of this Department it appears that in the summer of 1933, Arthur E. Johnson had unlawfully sold, among other timber for which settlement has been made, $63 worth of staves taken from the SE1/4 NE1/4, NE1/4 SE1/4 sec. 15, T. 10 N., R. 17 W., 5th F.N., Arkansas, embraced in his then pending homestead entry, identified as G. L. O. 04155, which was later canceled."

By settlement No. US-7310-L, dated July 30, 1940, this office certified Arthur E. Johnson to be indebted to the United States in the sum of $63. The efforts of the Department of the Interior and of this office to effect collection having been unsuccessful, it is suggested that the indebtedness be referred to the appropriate United States Attorney for collection, the amount collected to be deposited for covering into the Treasury to the credit of the receipt account, "146881 Sale of Public Land, Arkansas."

In the event it is found necessary to institute suit, a transcript will be furnished promptly upon receipt of your request therefor.
