MR. HAROLD F. WHEELER:

REFERENCE IS MADE TO YOUR LETTER OF JANUARY 6, 1954, AND ENCLOSURES, REQUESTING REVIEW OF THAT PART OF SETTLEMENT DATED DECEMBER 23, 1953, WHICH DISALLOWED YOUR CLAIM FOR REIMBURSEMENT OF THE COST OF SHIPMENT OF HOUSEHOLD EFFECTS AND TRANSPORTATION OF DEPENDENTS FROM FORT GEORGE G. MEADE, MARYLAND, TO SANTA MONICA, CALIFORNIA, INCIDENT TO YOUR RELEASE FROM ACTIVE DUTY AS WARRANT OFFICER, JUNIOR GRADE, ARMY OF THE UNITED STATES.

THE RECORD SHOWS THAT BY ORDERS DATED MARCH 6, 1953, YOU WERE RELEASED FROM ACTIVE DUTY AS WARRANT OFFICER, JUNIOR GRADE, ARMY OF THE UNITED STATES AT FORT GEORGE G. MEADE, MARYLAND, EFFECTIVE MARCH 7, 1953; THAT YOUR ACTIVE SERVICE AS AN ENLISTED MAN AND WARRANT OFFICER HAD BEEN CONTINUOUS SINCE NOVEMBER 14, 1948; AND THAT YOUR HOME AND PLACE OF ENTRY ON ACTIVE DUTY AS AN ENLISTED MAN IN 1948 WAS LOS ANGELES, CALIFORNIA. SETTLEMENT DATED DECEMBER 23, 1953, YOU WERE ALLOWED THE BALANCE DUE YOU AS MILEAGE FOR YOUR TRAVEL INCIDENT TO YOUR SEPARATION FROM THE SERVICE. FINAL ACTION ON YOUR CLAIM FOR REIMBURSEMENT OF THE COST OF SHIPPING YOUR HOUSEHOLD EFFECTS AND TRAVEL OF DEPENDENTS WAS WITHHOLD FOR ADDITIONAL EVIDENCE, A PART OF WHICH HAS NOW BEEN FURNISHED.

SINCE IT APPEARS THAT YOUR HOME OF RECORD WHEN YOU ENTERED ON THE SAID CONTINUOUS ACTIVE DUTY IN 1948 WAS LOS ANGELES, CALIFORNIA, ALTHOUGH THE ORDERS OF MARCH 6, 1953, SHOW THAT YOUR HOME WAS RECORDED AT THE TIME OF YOUR ENTRY ON DUTY AS A WARRANT OFFICER AS PLATTSBURG, NEW YORK, YOU ARE ENTITLED TO REIMBURSEMENT FOR THE TRAVEL PERFORMED BY YOUR DEPENDENTS (WIFE AND CHILDREN, AGES 10, 7, 5 AND 1) FROM FORT GEORGE G. MEADE, MARYLAND, TO LOS ANGELES, CALIFORNIA, BETWEEN THE DATES APRIL 6 AND 20, 1953. A SETTLEMENT WILL ISSUE AT THE EARLIEST PRACTICABLE DATE FOR THE AMOUNT FOUND TO BE DUE AS REIMBURSEMENT FOR SUCH TRAVEL.

IT APPEARS THAT ON JUNE 16, 1953, YOUR HOUSEHOLD EFFECTS WEIGHING 3,410 POUNDS WERE SHIPPED BY VAN FROM FORT GEORGE G. MEADE, MARYLAND, VIA BETHSEDA, MARYLAND, TO SANTA MONICA, CALIFORNIA, WHERE THEY ARE BEING HELD IN COMMERCIAL STORAGE FOR THE REASON THAT YOU HAVE NOT PAID THE CARRIER THE CHARGES FOR PACKING, STORAGE AND TRANSPORTATION. PARAGRAPH 8150 OF THE JOINT TRAVEL REGULATIONS, PROMULGATED PURSUANT TO SECTION 303(C) OF THE CAREER COMPENSATION ACT OF 1949, 63 STAT. 814, PROVIDES THAT EACH CLAIM FOR REIMBURSEMENT OF THE COST OF SHIPPING HOUSEHOLD EFFECTS WILL BE SUPPORTED AMONG OTHER THINGS BY RECEIPTED BILLS SHOWING PAYMENT IN FULL OF PACKING, CRATING, DRAYAGE, STORAGE AND TRANSPORTATION COSTS. SINCE YOU HAVE NOT PAID THE CARRIER THE CHARGES FOR THE TRANSPORTATION OF YOUR HOUSEHOLD EFFECTS YOU DO NOT NOW HAVE A CLAIM SUCH AS MAY BE CONSIDERED BY THIS OFFICE. HOWEVER, UPON RECEIPT OF SATISFACTORY EVIDENCE THAT YOU HAVE PAID THE CARRIER, A SETTLEMENT WILL ISSUE FOR THE AMOUNT PROPERLY FOUND TO BE DUE YOU AS REIMBURSEMENT FOR PACKING, STORAGE AND TRANSPORTATION OF YOUR HOUSEHOLD EFFECTS FROM FORT GEORGE G. MEADE, MARYLAND, TO LOS ANGELES, CALIFORNIA.
