REFERENCE IS MADE TO YOUR LETTERS OF MAY 10 AND 22, 1956, FORWARDED TO US BY THE DEPARTMENT OF THE ARMY FURTHER CONCERNING YOUR CLAIM FOR ARREARS OF PAY, ALLOWANCES AND SAVINGS DEPOSITS BELIEVED TO BE DUE IN THE CASE OF THE LATE GILBERT DEIGHTON FRANCIS, WHO DIED ON MARCH 29, 1953, WHILE SERVING AS PRIVATE, ARMY OF THE UNITED STATES.

IN OUR DECISION OF SEPTEMBER 24, 1953, B-116627, TO YOU, A COPY OF WHICH IS ENCLOSED, THE REASONS WHY YOUR CLAIM, PRESENTED AS AUNT AND FOSTER MOTHER OF THE DECEDENT, COULD NOT BE ALLOWED WERE FULLY EXPLAINED TO YOU. YOUR PRESENT COMMUNICATIONS PRESENT NO EVIDENCE OR INFORMATION NOT PREVIOUSLY CONSIDERED WHICH WOULD WARRANT FURTHER OR DIFFERENT ACTION. WHILE YOU NOW SAY THAT YOU WERE THE LATE SOLDIER'S GREAT-AUNT RATHER THAN HIS AUNT, THAT AFFORDS NO BASIS FOR CHANGING THE CONCLUSIONS REACHED IN THE DECISION OF SEPTEMBER 24, 1953, THE STATEMENTS THERE MADE RESPECTING AN AUNT ALSO BEING APPLICABLE TO A GREAT-AUNT. FURTHER, YOU ARE ADVISED THAT AFTER THE RECEIPT OF A CLAIM BY IVY LEONORA HARRISON GAYLE, MOTHER OF THE DECEDENT, FOR SUCH ARREARS OF PAY, ALLOWANCES AND SAVINGS DEPOSITS, OUR CLAIMS DIVISION ON AUGUST 26, 1954, CERTIFIED FOR PAYMENT TO HER THE SUM OF $75.77 REPRESENTING HER ONE-HALF SHARE OF THE AMOUNT DUE, THE REMAINING ONE HALF SHARE BEING RESERVED FOR THE DECEDENT'S FATHER PENDING RECEIPT OF A CLAIM FROM HIM FOR SUCH SHARE.
