REFERENCE IS MADE TO YOUR LETTERS DATED APRIL 3 AND MAY 1, 1953, RELATIVE TO YOUR CLAIM FOR BASIC ALLOWANCE FOR QUARTERS IN YOUR OWN RIGHT FOR THE PERIOD FROM NOVEMBER 7, 1951, TO MARCH 21, 1952, INCIDENT TO YOUR SERVICE AS CORPORAL, WOMENS AIR FORCE.

THE DISALLOWANCE OF SUCH CLAIM BY GENERAL ACCOUNTING OFFICE SETTLEMENT DATED JANUARY 8, 1953, WAS SUSTAINED BY DECISION OF APRIL 1, 1953, B- 113653, TO YOU, FOR THE REASON THAT IT HAD NOT BEEN SHOWN THAT YOUR COMMANDING OFFICER DETERMINED THAT QUARTERS WERE NOT AVAILABLE TO YOU IN YOUR INDIVIDUAL CAPACITY AS A MEMBER OF THE ARMED SERVICES.

WHILE YOU STATE IN THE SAID LETTERS OF APRIL 3 AND MAY 1, 1953, THAT YOU SUBMITTED A STATEMENT SIGNED BY YOUR COMMANDING OFFICER AND THE BASE HOUSING OFFICER, YOU ARE ADVISED THAT IT APPEARS THE ONLY STATEMENT SUBMITTED TO THIS OFFICE IN CONNECTION WITH YOUR CLAIM IS A "CERTIFICATE" DATED APRIL 28, 1952, BY LIEUTENANT COLONEL BERNARD F. WARAKOMSKI, USAF, BASE HOUSING OFFICER, TO THE EFFECT THAT GOVERNMENT QUARTERS WERE NOT AVAILABLE FOR ASSIGNMENT TO YOU AT FRANCIS E. WARREN AIR FORCE BASE, WYOMING, FROM NOVEMBER 7, 1951, TO MARCH 21, 1952. ASIDE FROM THE FACT THAT THE SAID CERTIFICATE DOES NOT DISCLOSE THAT IT WAS EXECUTED BY ORDER OF YOUR COMMANDING OFFICER, IT CAN NOT BE CONSIDERED AS A DETERMINATION THAT INDIVIDUAL "SINGLE" PUBLIC QUARTERS (AS DISTINGUISHED FROM FAMILY QUARTERS) WERE NOT AVAILABLE TO YOU. IN THAT CONNECTION SEE DECISION OF THIS OFFICE DATED FEBRUARY 20, 1953, 32 COMP. GEN. 368, COPY ENCLOSED, HOLDING THAT A MARRIED OFFICER OF THE WOMENS ARMY CORPS WHOSE HUSBAND IS NOT HER "DEPENDENT" MAY NOT BE PAID BASIC ALLOWANCE FOR QUARTERS AS AN OFFICER WITHOUT DEPENDENTS WHERE ADEQUATE "SINGLE" QUARTERS ARE AVAILABLE AT HER STATION AND ARE NOT OCCUPIED BY HER BECAUSE OF PERSONAL REASONS.

IN VIEW OF THE FOREGOING, THE SAID DECISION OF APRIL 1, 1953, TO YOU, SUSTAINING THE DISALLOWANCE OF YOUR CLAIM, IS AFFIRMED.
