B-111856, DEC. 7, 1956

TO MR. WILLIAM HOGG:

REFERENCE IS MADE TO YOUR LETTER OF OCTOBER 29, 1956, AGAIN REQUESTING CONSIDERATION OF YOUR CLAIM FOR REIMBURSEMENT FOR TRAVEL OF YOUR DEPENDENT PARENTS FROM TACOMA, WASHINGTON, TO HANCOCK, MICHIGAN, WHILE SERVING AS STAFF SERGEANT, UNITED STATES AIR FORCE.

YOUR CLAIM WAS CAREFULLY CONSIDERED BY US ON SEVERAL OCCASIONS AND NO LEGAL BASIS WAS FOUND FOR ITS ALLOWANCE. THE PRECISE POINT YOU NOW RAISE (THAT IS, THAT YOUR ORDERS TO ACTIVE DUTY CONTAINED A PROVISION FOR RELIEF FROM ACTIVE DUTY AFTER ONE YEAR'S SERVICE AND, THEREFORE, CONSTITUTED AUTHORITY FOR TRAVEL OF YOUR DEPENDENTS TO THEIR HOME AT ANY TIME FOLLOWING THEIR ARRIVAL AT YOUR STATION) WAS FULLY CONSIDERED IN OUR DECISION B-111856, DATED DECEMBER 11, 1952. THIS DECISION, WHICH SUBSEQUENTLY WAS RETURNED TO US, IS ENCLOSED SINCE IT SETS OUT IN DETAIL THE REASONS WHY YOUR CLAIM MAY NOT BE ALLOWED.

SINCE YOUR PRESENT LETTER FURNISHES NO EVIDENCE OR MATERIAL INFORMATION NOT PREVIOUSLY CONSIDERED, IT AFFORDS NO BASIS FOR MODIFICATION OF THE PRIOR ACTION IN YOUR CASE. THE PAPERS WHICH ACCOMPANIED YOUR LETTER ARE RETURNED HEREWITH AS REQUESTED, IT BEING CLEAR THAT (EXCEPT FOR THE ORDERS OF AUGUST 15, 1950, A COPY OF WHICH HAS LONG BEEN ON FILE) THEY HAVE NO BEARING ON YOUR CLAIM.
