HOUSEHOLD EFFECTS CONSISTING OF TWO BOXES AND TWO CRATES WEIGHING 703 POUNDS WERE SHIPPED BY RAILWAY EXPRESS TO SAN DIEGO. THAT CLAIM WAS DISALLOWED BY SETTLEMENT DATED APRIL 2. YOU STATE THAT THE EFFECTS INVOLVED WERE SHIPPED BY MISTAKE TO SAN DIEGO RATHER THAN TO LOS ALTOS. IN WHICH IT IS STATED THAT YOUR EFFECTS WERE SHIPPED IN ERROR TO SAN DIEGO. OF SAID REGULATIONS PROVIDES THAT WHEN HOUSEHOLD GOODS HAVE BEEN IMPROPERLY SHIPPED OR OTHERWISE UNAVOIDABLY SEPARATED FROM THE MEMBER. REFERENCE IS MADE TO YOUR LETTER OF MAY 19, 1952, REQUESTING REVIEW OF SETTLEMENT DATED APRIL 2, 1952, WHICH DISALLOWED YOUR CLAIM FOR REIMBURSEMENT OF THE COST OF SHIPPING HOUSEHOLD EFFECTS BY EXPRESS FROM SAN DIEGO, CALIFORNIA, TO LOS ALTOS, CALIFORNIA, ON SEPTEMBER 18, 1951.

BY ORDERS FROM THE CHIEF OF NAVAL PERSONNEL, DATED JULY 12, 1951, AND ENDORSEMENTS THEREON, YOU WERE DETACHED FROM DUTY AT GLENVIEW, ILLINOIS, AND ASSIGNED TO DUTY ABOARD THE U.S.S. BAIROKO (CVE 115). YOU REPORTED FOR DUTY ABOARD SAID VESSEL ON SEPTEMBER 7, 1951. IN AN APPLICATION SIGNED BY YOU, DATED AUGUST 2, 1951, YOU REQUESTED THE SHIPMENT BY EXPRESS OF YOUR HOUSEHOLD EFFECTS FROM 725 PARK ROAD, FOREST LAKES, ILLINOIS, TO THE SUPPLY OFFICER, NAVAL SUPPLY DEPOT, SAN DIEGO, CALIFORNIA. PURSUANT TO SAID APPLICATION, HOUSEHOLD EFFECTS CONSISTING OF TWO BOXES AND TWO CRATES WEIGHING 703 POUNDS WERE SHIPPED BY RAILWAY EXPRESS TO SAN DIEGO, CALIFORNIA, ON GOVERNMENT BILL OF LADING NO. N 9315111, ISSUED ON AUGUST 8, 1951, AT A COST TO THE GOVERNMENT OF $95.95. IT APPEARS THAT ON SEPTEMBER 18, 1951, YOU SHIPPED BY RAILWAY EXPRESS HOUSEHOLD EFFECTS WEIGHING 350 POUNDS, CONSISTING OF TWO CRATES AND ONE BOX FROM SAN DIEGO, CALIFORNIA TO LOS ALTOS, CALIFORNIA, AT PERSONAL EXPENSE OF $21.17, FOR WHICH YOU CLAIMED REIMBURSEMENT. THAT CLAIM WAS DISALLOWED BY SETTLEMENT DATED APRIL 2, 1952. IN YOUR REQUEST FOR REVIEW OF THE SAID SETTLEMENT, YOU STATE THAT THE EFFECTS INVOLVED WERE SHIPPED BY MISTAKE TO SAN DIEGO RATHER THAN TO LOS ALTOS, CALIFORNIA, AS ORIGINALLY REQUESTED BY YOU. THIS CONNECTION THE FILE CONTAINS A LETTER FROM THE SUPPLY AND FISCAL OFFICER, UNITED STATES NAVAL AIR STATION, GLENVIEW, ILLINOIS, TO THE SUPPLY AND FISCAL OFFICER, NAVAL SUPPLY DEPOT, SAN DIEGO, CALIFORNIA, DATED SEPTEMBER 20, 1951, IN WHICH IT IS STATED THAT YOUR EFFECTS WERE SHIPPED IN ERROR TO SAN DIEGO, INSTEAD OF TO LOS ALTOS, CALIFORNIA.

PARAGRAPH 8013-1, JOINT TRAVEL REGULATIONS, PROVIDES THAT UNLESS OTHERWISE SPECIFICALLY PROVIDED THEREIN, SHIPMENT OF HOUSEHOLD GOODS AT GOVERNMENT EXPENSE EXTENDS ONLY TO THE THROUGH SHIPMENT TO THE AUTHORIZED ULTIMATE DESTINATION OF THE SAME LOT OF HOUSEHOLD GOODS OR EFFECTS AND THAT SHIPMENT MAY NOT BE MADE FOR THE CONVENIENCE OF THE MEMBER TO SOME OTHER PLACE FOR RESHIPMENT LATER TO SUCH AUTHORIZED ULTIMATE DESTINATION. PARAGRAPH 8013-2, OF SAID REGULATIONS PROVIDES THAT WHEN HOUSEHOLD GOODS HAVE BEEN IMPROPERLY SHIPPED OR OTHERWISE UNAVOIDABLY SEPARATED FROM THE MEMBER, NOT BECAUSE OF THE FAULT OF THE MEMBER, THEY MAY BE FORWARDED TO THE PROPER DESTINATION AT GOVERNMENT EXPENSE UPON APPROVAL OF THE SERVICE CONCERNED.

WHILE THE SUPPLY AND FISCAL OFFICER, WHO SHIPPED YOUR EFFECTS STATES THAT THEY WERE SHIPPED IN ERROR TO SAN DIEGO, INSTEAD OF TO LOS ALTOS, CALIFORNIA, IT APPEARS THAT SUCH SHIPMENT WAS MADE TO SAN DIEGO IN ACCORDANCE WITH THE APPLICATION SIGNED BY YOU. HENCE, UNDER THE ABOVE CITED REGULATIONS AND ON THE PRESENT RECORD, YOU WERE NOT ENTITLED TO SHIPMENT AT GOVERNMENT EXPENSE OF THE HOUSEHOLD EFFECTS INVOLVED FROM SAN DIEGO TO LOS ALTOS, CALIFORNIA. ACCORDINGLY, THE SETTLEMENT OF APRIL 2, 1952 IS SUSTAINED.
