REFERENCE IS MADE TO THE CLAIM OF THE UNITED STATES AGAINST RICHARD H. BACKUS, BAY ROAD, WEBSTER, NEW YORK (PRESENT ADDRESS FERNOW HALL, CORNELL UNIVERSITY, ITHACA, NEW YORK), FORMERLY FIRST LIEUTENANT, ARMY AIR FORCE, 0-814216, FOR $313.12, REPRESENTING THE VALUE OF GOVERNMENT PROPERTY LOST WHILE IN HIS CUSTODY.

THE CLAIM, TOGETHER WITH SIMILAR CLAIMS AGAINST OTHER ARMY PERSONNEL, WAS CERTIFIED TO THE CLAIMS DIVISION OF THIS OFFICE BY THE OFFICE OF THE CHIEF OF FINANCE, WAR DEPARTMENT, BY LETTER OF DECEMBER 4, 1946 (FINCU 141.8 ERBEN, J.B. CAPT. $27.36), AS HAVING BEEN BASED ON A DETERMINATION BY THE SECRETARY OF WAR UNDER THE PROVISIONS OF SECTIONS 1 AND 2 OF THE ACT OF MARCH 29, 1894, 28 STAT. 47, AS AMENDED, 31 U.S.C. 89, 90. UPON REQUEST, FURTHER INFORMATION WAS FURNISHED BY SAID OFFICE BY FIRST INDORSEMENT OF OCTOBER 23, 1951 (FINEP-A 114.8 DAHL, H.A. LT., $1,051.00).

THE CLAIMS DIVISION OF THIS OFFICE WROTE TO MR. BACKUS UNDER DATE OF DECEMBER 4, 1951, REQUESTING PAYMENT OF THE AMOUNT OF THE REPORTED INDEBTEDNESS, WITH INTEREST AT 6 PERCENT FROM DECEMBER 4, 1946. BY LETTER OF DECEMBER 12, 1951, THE DEBTOR WROTE TO HONORABLE KENNETH B. KEATING, HOUSE OF REPRESENTATIVES, IN EFFECT DENYING LIABILITY. BY LETTER OF DECEMBER 17, 1951, CONGRESSMAN KEATING REQUESTED THAT CONSIDERATION BE GIVEN MR. BACKUS' ALLEGATIONS AND THAT INFORMATION BE FURNISHED HIM AS TO THE POSSIBILITY OF FURTHER APPEAL IN THE MATTER.

A COPY OF MR. BACKUS' LETTER OF DECEMBER 12, 1951, IS FORWARDED HEREWITH FOR SUCH CONSIDERATION AS YOU MAY DEEM APPROPRIATE, AND WITH THE REQUEST THAT A FURTHER REPORT WITH RESPECT THERETO BE FURNISHED THIS OFFICE. FURTHER ACTION IN THE MATTER WILL BE HELD IN ABEYANCE PENDING RECEIPT OF YOUR REPORT.
