BY LETTER DATED MARCH 1, 1951, THE DIRECTOR OF FINANCE FORWARDED TO THIS OFFICE YOUR LETTER OF SEPTEMBER 29, 1950, REQUESTING AN ADVANCE DECISION ON THE CLAIM OF JOSEPH PELLICANE, FATHER OF ROBERT R. PELLICANE, DECEASED, LATE FIRST LIEUTENANT, HEADQUARTERS AND HEADQUARTERS SQUADRON, 52ND FIGHTER WING, NEW YORK AIR NATIONAL GUARD, FOR ARMORY DRILL PAY AND FLYING PAY DUE THE DECEDENT AT THE DATE OF HIS DEATH, MAY 3, 1950, SUPPORTED BY SUPPLEMENTAL ARMORY DRILL PAY ROLL OF THE SAID ORGANIZATION FOR THE PERIOD FROM FEBRUARY 1, 1950, TO APRIL 30, 1950.

IT IS STATED ON STANDARD FORM NO. 1055 THAT NO EXECUTOR OR ADMINISTRATOR OF THE DECEDENT'S ESTATE HAS BEEN OR WILL BE APPOINTED; THAT HE IS NOT SURVIVED BY A WIDOW, CHILDREN, OR GRANDCHILDREN; THAT HE IS SURVIVED BY JOSEPH PELLICANE, HIS FATHER, AND CATHERINE C. PELLICANE, HIS MOTHER; AND THAT HIS FUNERAL EXPENSES HAVE BEEN PAID, IN PART, FROM FUNDS OF THE FATHER. A CERTIFIED TRUE COPY OF THE UNDERTAKER'S BILL IN THE TOTAL SUM OF $788 HAS BEEN PRESENTED INDICATING THAT PAYMENT HAS BEEN MADE IN FULL. INFORMATION CONTAINED IN 12TH INDORSEMENT DATED JANUARY 9, 1951, FROM HEADQUARTERS, DEPARTMENTS OF THE ARMY AND THE AIR FORCE, NATIONAL GUARD BUREAU, TO CHIEF OF STAFF, UNITED STATES AIR FORCE, INDICATES THAT THE SUM OF $541 OF THE TOTAL AMOUNT DUE FOR FUNERAL EXPENSES HAS BEEN APPROVED FOR PAYMENT BY THE UNITED STATES GOVERNMENT, LEAVING A BALANCE OF $247, WHICH APPEARS TO HAVE BEEN PAID BY THE FATHER.

THE CLAIMANT APPEARS TO BE ENTITLED, AS PART PAYER OF THE FUNERAL EXPENSES OF ROBERT R. PELLICANE, DECEASED, TO SUCH AMOUNT AS WAS LEGALLY DUE THE DECEDENT FOR ARMORY DRILL PAY AND FLYING PAY AT THE DATE OF HIS DEATH (SEE THE ACT OF JUNE 30, 1906, 34 STAT. 750, AS AMENDED BY SECTION 4 OF THE ACT OF FEBRUARY 25, 1946, 60 STAT. 30) AND PAYMENT TO THE CLAIMANT IN THAT AMOUNT IS AUTHORIZED, IF OTHERWISE CORRECT, PROVIDED A RECEIPTED UNDERTAKER'S BILL, SHOWING PAYMENT BY THE FATHER IN AN AMOUNT EQUALING OR EXCEEDING THE AMOUNT DUE THE DECEDENT'S ESTATE, IS ATTACHED TO THE SUPPLEMENTAL PAY ROLL, NO DETERMINATION BEING MADE HEREIN AS TO THE CORRECT AMOUNT OF SUCH PAYMENT, OR AS TO THE CORRECTNESS OF THE SUPPLEMENTAL PAY ROLL IN OTHER RESPECTS.
