The Navy Department requested reconsideration of a decision of December 1, 1925, regarding the appropriation Pay Miscellaneous being a specific appropriation for mileage the payment of mileage or expenses in connection therewith from the proceeds of condemned Government property, is not authorized. This decision appeared to overrule a previous decision holding that 'mileage or actual and necessary expenses of naval officers when engaged or traveling in connection with the sale of surplus and condemned property are expenses in connection with the sale of such property' and properly chargeable to the Naval Working Fund. The Navy department requested to be advised, in view of the conflicting decisions, respecting the appropriation or fund properly chargeable with the mileage and necessary traveling expenses incurred in connection with the sale of surplus or condemned property.
