McRae Industries, Inc.

A firm protested Defense Supply Center Philadelphia (DSCP) contract awards for intermediate cold/wet boots with removable insulated booties, contending that DSCP improperly waived the solicitation's testing requirement. GAO held that (1) DSCP fairly decided to waive the testing because all offerors' samples would have passed the omitted tests; and (2) the test results would not have changed the outcome of the award decision. Accordingly, the protest was denied.
