The New Jersey & H Street Limited Partnership

A firm protested a U.S. Securities and Exchange Commission (SEC) contract award for construction and lease of office space, contending that SEC incorrectly failed to advise the protester that its proposal was eliminated because it did not fall into the competitive range. GAO found that SEC (1) fairly eliminated the proposal from consideration because it fell outside the competitive range and (2) was not required to provide the protester opportunity to submit revised proposal based on amended requirements. Accordingly, the protest was denied.
