Claims for BAQ and VHA at the With-Dependent Rate

The Air Force requested an advanced decision on whether its employee, a divorced father with shared custody of his son, may claim basic allowance for quarters and variable housing allowance at the rates for members with dependent children. GAO held that the employee was not entitled to the housing rates for members with dependent children, since he did not have physical custody of the child on a non-temporary basis. Accordingly, the claim was denied.
