PAY - ARMORY DRILL - NATIONAL GUARD A COMMISSIONED OFFICER OF A NATIONAL GUARD SERVICE COMPANY WHO ATTENDS DRILLS OF THE BAND SECTION OF THAT COMPANY IS NOT ENTITLED TO CREDIT FOR PAY PURPOSES FOR THE DRILLS SO ATTENDED. REQUESTING DECISION AS TO WHETHER PAYMENT OF SAME IS AUTHORIZED. IS A SEPARATE AND DISTINCT ORGANIZATION WITHIN THE MEANING OF THE LAWS AND REGULATIONS PROVIDING FOR ARMORY DRILL PAY. 1 COMP. IT HAS ALSO BEEN UNIFORMLY HELD UNDER THE LAW AND EXISTING REGULATIONS THAT AN OFFICER BELONGING TO ONE ORGANIZATION WHO PARTICIPATES IN DRILLS WITH ANOTHER ORGANIZATION IS NOT ENTITLED TO CREDIT FOR PAY PURPOSES FOR THE DRILLS SO ATTENDED. THE REASON FOR THIS HOLDING IS EQUALLY APPLICABLE TO A COMMISSIONED OFFICER OF A SERVICE COMPANY WHO ATTENDS DRILLS OF THE BAND SECTION OF THAT COMPANY.

THERE HAS BEEN RECEIVED YOUR LETTER OF NOVEMBER 19, 1929, TRANSMITTING SUPPLEMENTAL PAY ROLL OF SERVICE SECTION, SERVICE COMPANY, ONE HUNDRED AND SIXTY-EIGHTH INFANTRY, IOWA NATIONAL GUARD, MARCH 1 TO MAY 31, 1929, COVERING CLAIM OF CAPT. EVERETT M. SWANSON AND SECOND LIEUT. DONALD W. SNYDER FOR ARMORY DRILL PAY FOR ATTENDING DRILLS WITH THE BAND SECTION OF THAT COMPANY DURING THIS PERIOD, AND REQUESTING DECISION AS TO WHETHER PAYMENT OF SAME IS AUTHORIZED.

IT HAS BEEN HELD THAT THE BAND SECTION OF A SERVICE COMPANY, ALTHOUGH INCLUDED IN SUCH COMPANY FOR ADMINISTRATIVE PURPOSES, IS A SEPARATE AND DISTINCT ORGANIZATION WITHIN THE MEANING OF THE LAWS AND REGULATIONS PROVIDING FOR ARMORY DRILL PAY. 1 COMP. GEN. 665.

IT HAS ALSO BEEN UNIFORMLY HELD UNDER THE LAW AND EXISTING REGULATIONS THAT AN OFFICER BELONGING TO ONE ORGANIZATION WHO PARTICIPATES IN DRILLS WITH ANOTHER ORGANIZATION IS NOT ENTITLED TO CREDIT FOR PAY PURPOSES FOR THE DRILLS SO ATTENDED.
