TO THE SECRETARY OF THE NAVY: REFERENCE IS MADE TO LETTER DATED MARCH 19. THIS MATTER FIRST WAS BROUGHT TO THE ATTENTION OF YOUR DEPARTMENT BY OUR LETTER OF JUNE 15. - WAS FORWARDED HERE WITH THE LETTER OF MARCH 19. WE REASONABLY MAY CONCLUDE THAT THE OFFICER'S MOTHER WAS IN FACT DEPENDENT ON HIM FOR CHIEF SUPPORT DURING THE PERIOD FROM SEPTEMBER 1. WAS MORE THAN ONE-HALF OF THE FAMILY LIVING EXPENSES. - IT APPEARS THAT THE MOTHER WAS NOT IN FACT DEPENDENT ON THE OFFICER FOR HER CHIEF SUPPORT DURING THAT PERIOD.

REFERENCE IS MADE TO LETTER DATED MARCH 19, 1956, FROM THE HEAD, OFFICER PERFORMANCE BRANCH, BUREAU OF NAVAL PERSONNEL, DEPARTMENT OF THE NAVY (REFERENCE PERS B723-MJZ 432656/1100), AND ENCLOSURES PERTAINING TO IMPROPER PAYMENTS OF INCREASED RENTAL AND SUBSISTENCE ALLOWANCES MADE TO (THEN) LIEUTENANT (JG) ROBERT C. FULLER, JR., USN, 432656/1100. THIS MATTER FIRST WAS BROUGHT TO THE ATTENTION OF YOUR DEPARTMENT BY OUR LETTER OF JUNE 15, 1951, I-17000-675, AND AGAIN BY OUR LETTER OF AUGUST 13, 1952; B-86001-/F) ( I-17000-675.

BUREAU OF NAVAL PERSONNEL LETTER OF FEBRUARY 20, 1956, TO LIEUTENANT FULLER RESULTED IN HIS REPLY DATED MARCH 7, 1956, A COPY OF WHICH--- WITH PHOTOSTATIC COPIES OF THREE AFFIDAVITS--- WAS FORWARDED HERE WITH THE LETTER OF MARCH 19, 1956, CITED ABOVE.

FROM THE EVIDENCE NOW FOR CONSIDERATION, WE REASONABLY MAY CONCLUDE THAT THE OFFICER'S MOTHER WAS IN FACT DEPENDENT ON HIM FOR CHIEF SUPPORT DURING THE PERIOD FROM SEPTEMBER 1, 1947, THROUGH APRIL 14, 1948. HOWEVER, UNDER THE FAMILY UNIT RULE--- IT APPEARING THAT THE INCOME OF THE OFFICER'S FATHER DURING THE PERIOD APRIL 15, 1948, THROUGH APRIL 4, 1949, WAS MORE THAN ONE-HALF OF THE FAMILY LIVING EXPENSES--- IT APPEARS THAT THE MOTHER WAS NOT IN FACT DEPENDENT ON THE OFFICER FOR HER CHIEF SUPPORT DURING THAT PERIOD.

ACCORDINGLY, FURTHER CONSIDERATION BY YOUR DEPARTMENT WITH A VIEW TO RECOVERY OF THE IMPROPER PAYMENTS MADE TO LIEUTENANT FULLER AND INFORMATION AS TO THE AMOUNTS COLLECTED WILL BE ..END :
