REFERENCE IS MADE TO YOUR LETTER DATED JULY 29, 1961, TRANSMITTED HERE BY HONORABLE GEORGE A. SMATHERS, UNITED STATES SENATE. IN YOUR LETTER YOU REQUEST THAT YOUR ELECTION OF OPTIONS UNDER THE UNIFORMED SERVICES CONTINGENCY OPTION ACT OF 1953 BE HELD NULL AND VOID BECAUSE BASED ON ERRONEOUS INFORMATION.

THERE IS ENCLOSED A COPY OF OUR DECISION OF TODAY TO THE SECRETARY OF THE ARMY CONCERNING THE MATTER OF YOUR ELECTION OF OPTIONS AND THE MATTER OF THE COST OF ANNUITY FOR BENEFICIARIES FOR THE PERIOD NOVEMBER 1, 1953, THROUGH JUNE 30, 1957, INCIDENT TO THE PAYMENT OF RETROACTIVE RETIREMENT PAY.

IT WILL BE OBSERVED THAT WE HAVE INFORMED THE SECRETARY OF THE ARMY OF OUR VIEWS THAT YOUR ELECTION IS NOT BINDING ON YOU BECAUSE YOU WERE MISINFORMED OF A MATERIAL FACT AT THE TIME YOU MADE THE ELECTION IN 1957 AND THAT YOU MAY RATIFY OR DISAFFIRM THAT ELECTION. IT IS SUGGESTED THAT, WITHIN THIRTY DAYS OF THE DATE OF THIS LETTER, YOU ADDRESS A LETTER TO THE EXECUTIVE OFFICER, FINANCE CENTER, U.S. ARMY, INDIANAPOLIS 49, INDIANA, ADVISING HIM WHETHER YOU CHOOSE TO RATIFY OR DISAFFIRM YOUR ELECTION.
