The protesters argue that these rejections were improper. The agency states that it has issued an amendment to the RF deleting that portion of the solicitation calling for the rejection of initial offers where adequate and complete test data is not furnished therewith. The agency also intends to reconsider all proposals which were initially rejected. To allow offerors to submit test data which were omitted from the initial proposals and to conduct discussions with all offerors concerning the adequacy of test data submitted. We believe that the issues raised by the protesters concerning their exclusion from the competition have been rendered academic. therefore dismiss the protests. /1/ Shaw/Walker.

PROCUREMENT - Bid Protests - Moot allegation - GAO review DIGEST: Where agency affords protesters relief requested in protests, General Accounting Office dismisses the protests as academic.

Center Core, Inc. /1/:

Center Core, Inc. and 16 other firms protest the rejection of their respective offers under request for proposals (RFP) No. FCN0-87-B701-B-1- 26-88, issued by the General Services Administration (GSA) for the acquisition of automatic data processing furniture. GSA rejected the protesters' offers without discussions because, according to the agency, each firm failed in some respect to supply complete and adequate "test data" with its offer as called for in the solicitation. The protesters argue that these rejections were improper.

Subsequent to the filing of the protests in this case, GSA, by letter dated April 15, 1988, informed our Office that it intended to take various corrective measures. Specifically, the agency states that it has issued an amendment to the RF deleting that portion of the solicitation calling for the rejection of initial offers where adequate and complete test data is not furnished therewith. The agency also intends to reconsider all proposals which were initially rejected, to allow offerors to submit test data which were omitted from the initial proposals and to conduct discussions with all offerors concerning the adequacy of test data submitted.

Because of the recent actions taken by GSA after the filing of the protests, we believe that the issues raised by the protesters concerning their exclusion from the competition have been rendered academic. therefore dismiss the protests.
