PROCUREMENT Sealed Bidding Bids Responsiveness Certification Signatures Bid was properly rejected as nonresponsive where the bid did not contain a required signed Certificate of Procurement Integrity. It is well-settled that the requirement to submit a signed Certificate of Procurement Integrity is a material one. The fact that a signed certificate was furnished with a bid on another procurement cannot cure the failure to provide one with the bid for this procurement since the law envisions a separate certification for each procurement. The rejection of the bid was proper. The protest is dismissed.

DECISION GZA Remediation, Inc. protests the rejection of its bid under
invitation for bids (IFB) No. DACA33-93-B-0057, issued by the U.S. Army
Corps of Engineers for closure of underground fuel tanks, Charlestown Navy
Yard, Charlestown, Massachusetts. The Corps rejected GZA's bid as
nonresponsive because it did not contain a signed Certificate of
Procurement Integrity.

GZA states that its failure to sign the certificate should be treated as
a minor informality and points to the fact that it has a signed
certificate on file with the same office in connection with another recent
procurement.

It is well-settled that the requirement to submit a signed Certificate of
Procurement Integrity is a material one, and that a bidder's failure to
submit a signed certificate with its bid requires that the bid be rejected
as nonresponsive. See McGuire Refrigeration, Inc., B-242754, May 31, 1991,
91-1 CPD Para. 519. The fact that a signed certificate was furnished with
a bid on another procurement cannot cure the failure to provide one with
the bid for this procurement since the law envisions a separate
certification for each procurement. Hein-Werner Corp., 71 Comp.Gen. 421
(1992), 92-1 CPD Para. 484. Accordingly, the rejection of the bid was
proper.

The protest is dismissed.
