A firm protested a Department of Education contract award for filing systems, contending that Education failed to: (1) make award to low-priced, technically acceptable bidder; and (2) afford it an opportunity to respond to a revision to Education's requirements. GAO held that Education: (1) was not required to conduct a best value evaluation or perform a tradeoff, since it rejected the protester's bid for nonresponsiveness; and (2) properly rejected the protester's lower-priced bid because it did not meet delivery requirements. Accordingly, the protest was denied.
