A firm protested an Army solicitation for targetry systems, contending that the solicitation improperly required the submission of proprietary data. GAO held that the: (1) protester's contention was rendered academic when the Army waived the application of the regulation; and (2) protester failed to raise a timely objection to the waiver. Accordingly, the protest was denied.
