A firm protested the Federal Bureau of Investigation's (FBI) rejection of its bid and subsequent contract award for x-ray systems, contending that the FBI improperly determined that its equipment would not meet the agency's need. GAO held that the FBI unreasonably determined that the protester's x-ray system would not meet its needs. Accordingly, the protest was sustained, and GAO recommended that the FBI: (1) determine whether the solicitation articulates its needs; (2) determine whether the protester's bid meets those needs; (3) terminate the awardee's contract and make award to protester, if otherwise appropriate; and (4) reimburse the protester for its protest costs.
