[Protest of Army Contract Award for Targetry Systems]
Highlights
A firm protested an Army contract award for targetry systems, contending that the Army improperly: (1) evaluated the awardee's proposal; and (2) failed to apply the Buy National American Act price evaluation factor to the awardee's proposal. GAO held that: (1) the Army unreasonably evaluated the awardee's proposal as excellent, since the awardee's bid demonstrated that it did not meet the solicitation's requirements; and (2) GAO would not review the Army's determination to waive the Buy American Act requirements. Accordingly, the protest was sustained, and GAO recommended that the Army: (1) reopen the procurement and reevaluate proposals in accordance with the stated evaluation scheme; (2) terminate the awardee's contract and make award to the bidder offering the best value to the government; and (3) reimburse the protester for its protest costs.
