A firm protested a Navy contract award for refuse collection, contending that the Navy: (1) did not conduct an extensive investigation of the awardee's past performance as a result of a False Claims Act litigation involving the awardee; and (2) improperly evaluated its proposal. GAO held that the Navy: (1) was not required to conduct a more extensive investigation of the awardee's involvement with the False Claims Act litigation, since the litigation had been resolved through a settlement agreement; (2) reasonably evaluated the protester's bid in accordance with stated evaluation factors; and (3) properly evaluated the protester's bid as posing a higher past performance risk, since the protester's performance history as stated in its proposal was less relevant to the solicited requirements than that of bidders rated as having a low performance risk. Accordingly, the protest was denied.
