[Protest of Navy Rejection of Bid for Construction Services]

A firm protested the Navy's rejection of its bid for construction, contending that the: (1) Navy's evaluation of its proposal was flawed and inconsistent with the solicitation; and (2) Navy improperly evaluated the proposals submitted by two firms selected to proceed to phase two of the procurement. GAO held that: (1) the Navy evaluated the protester's proposal in accordance with the evaluation factors announced in the solicitation and the record supported the protester's overall lower technical rating; (2) disparities in evaluation ratings among technical evaluators did not establish that the evaluation process was flawed; and (3) even if the protester's allegations that Navy improperly evaluated the first- and fourth-ranked proposals were sustained, the protester's proposal would not be eligible to proceed to phase two of the procurement. Accordingly, the protest was denied.
