[Protest of Navy Contract Award for Information Technology Equipment]
Highlights
A firm protested a Navy contract award for information technology equipment, contending that the: (1) awardee's revised proposal was technically unacceptable; and (2) Navy unreasonably failed to consider explanations about its adverse past performance to negate evaluated risk for packaging strategies. GAO held that the Navy: (1) properly evaluated the awardee's revised proposal as technically acceptable; (2) properly evaluated the protester's bid as high risk, since the protester's explanations of instances of late delivery and quality deficiencies did not negate the occurrence of these events, nor addressed how the protester would prevent similar events from occurring in the future; and (3) conducted a proper cost/technical tradeoff in selecting the awardee's higher-priced, technically superior bid. Accordingly, the protest was denied.
