A firm protested a Department of Veterans Affairs (VA) contract award for medical waste removal and disposal services, contending that VA improperly evaluated option prices in determining the lowest-priced bid. The firm also requested a reconsideration of its denied protest against the terms of the solicitation. In its request for reconsideration the protester contended that, as the lowest-priced bidder for the base year, it was sufficiently interested to file a protest against the solicitation terms. GAO held that: (1) VA properly applied the solicitation providing for award on the basis of price, including option years, since it determined that it was in the government's best interests; (2) the protester essentially reiterated arguments made previously; and (3) the protester failed to show any legal or factual errors that warranted reversal or modification of the original decision. Accordingly, the protest and request for reconsideration were denied.
