The Federal Highway Administration requested a decision on whether an employee who underwent childbirth at a temporary duty station was entitled to per diem during her incapacitation. GAO held that the employee was entitled to per diem for up to 14 days, since she was unable to perform her temporary duties while recovering from childbirth. Accordingly, the claim was allowed.
