A reemployed annuitant at the Occupational Safety and Health Administration requested reconsideration of the denial of his request for a waiver of salary overpayments. GAO had held that the claimant should have set aside a suspected salary overpayment. In his request for reconsideration, the claimant contended that: (1) the Department of Labor repeatedly assured him that it was paying him correctly; and (2) repayment would impose an undue hardship. GAO held that the claimant: (1) repeatedly informed Labor of this suspicion that he was being overpaid; and (2) reasonably relied on Labor's assurances that his salary was correct. Accordingly, waiver was granted.
