Questions were raised concerning a request, the Department of Justice submitted on behalf of the Army Corps of Engineers for the payment of $4.75 million from the Judgment Fund to Illinois for reimbursement of repair and restoration costs for bridges constructed by the government under the terms of an 1896 land condemnation decree. It was determined that payment from the Judgment Fund is only applicable when a judgment against the United States on a similar claim is payable from the Fund, therefore this claim must be paid from the acquiring agency's appropriations and not from the Judgment Fund.
