The Department of State requested reconsideration of a denied protest against its contract award for vehicle transportation. GAO had held that it had jurisdiction over a protest of an award under a common carrier tender, since the protest involved alleged violations of procurement statutes or regulations. In its request for reconsideration, State contended that GAO did not have jurisdiction over the protest, since procurements involving common carrier tenders service did not constitute a contract or necessarily result in a contract. GAO held that it had jurisdiction over the protest, since the Competition in Contracting Act's authority extended to procurement protests and encompassed acquisition of transportation services. Accordingly, the request for reconsideration was denied.
