[Claim for Waiver of Retired Pay Overpayments]

A retired Air Force officer requested waiver of indebtedness for retired pay overpayments, contending that he: (1) had no knowledge that his retired pay exceeded the dual compensation pay cap; and (2) repeatedly asked for explanations about how various pay changes affected his dual compensation. GAO held that the claimant was not without fault in accepting the overpayments, since his: (1) position and experience indicated that he should have been aware of the pay cap limitation; (2) pay remained stable and did not reflect dual compensation debt repayments after he completed repaying a previous indebtedness; and (3) correspondence about pay changes primarily concerned the effect of veterans compensation and did not address pay cap issues. Accordingly, the claim was denied.
