A private property owner claimed $55,000 for the alleged taking of his property, contending that an Army Corps of Engineers' water rediversion project rendered his property useless. GAO held that: (1) the river rediversion project was clearly an exercise of the government's power over navigable waters; and (2) the Corps reasonably determined that the flooding caused by the rediversion project did not exceed the ordinary high water mark. Accordingly, the claim was denied.
