A firm protested a Defense Personnel Support Center (DPSC) solicitation for extended cold weather camouflage trousers, contending that the: (1) required patented cloth failed to comply with military specifications; and (2) solicitation's patent indemnity clause resulted in a sole-source procurement. GAO held that the: (1) protester's allegation involving the patented cloth's deficient performance was a matter of contract administration not generally reviewed by GAO and was also not supported by the record; and (2) DPSC inclusion of the patent indemnity clause was unobjectionable. Accordingly, the protest was denied.
