[Comments on EPA Execution of Fuel Economy Testing]
B-217744.3, Nov 18, 1985
Comments were requested on matters concerning the Environmental Protection Agency's (EPA) execution of its fuel economy testing responsibilities under the Corporate Average Fuel Economy Program, including the: (1) statutory compliance of a recent final EPA rulemaking effort for future changes to test procedures; and (2) Center for Auto Safety's suggestion that another round of public notice and comment should have been solicited before the recent rule became final. GAO found that: (1) legislation requires test procedures to be established by rule and, if EPA does not justify each future use of informal procedures to issue test changes, it will be in violation of this statutory charge; and (2) the Center's allegation that EPA failed to publish its calculation method and provide sufficient notice of the adjustment was unfounded since, when read in conjunction with other publications, the notification was sufficient.
